Parking Eye Fine Antelope Park, Southampton

Do I ignore them and hope they go away, reply or just pay?
Thank you in advance.
I wrote..........
You issued me with a parking ticket on 01/03/22 but I believe it was unfairly issued. I decline your invitation to name the driver, which is not required of me as the keeper of the vehicle. I will not be paying your demand for payment for the following reasons: There was insufficient signage The car park in question has no clear signage to explain what the relevant parking restrictions are. This means no contract can be formed with the landowner and all tickets are issued illegally.
The charge is disproportionate and not commercially justifiable The amount you have charged is not based upon any commercially justifiable loss to your company or the landowner. In my case, the £100 charge you are asking for far exceeds the cost to the landowner of £2.60 I therefore feel the charge you have asked for is excessive.
If
you choose to pursue me please be aware that I will not enter into any
correspondence and this will be the only letter you will receive from me until
you answer the specific points raised in my letter.
They replied.........
Dear Sir / Madam,
Thank you for your appeal in relation to the Parking Charge incurred on 24 February 2022
at 14:53, at Antelope Retail Park Large car park.
We have reviewed the details outlined in your appeal, but we are not in receipt of
sufficient evidence to confirm that the terms and conditions were not breached. The
signage displayed on site confirms that there is a maximum stay time in operation. Our
records confirm that on the date of the event, the maximum stay time allowed was
exceeded.
We are writing to advise you that your recent appeal has been unsuccessful and that you
have now reached the end of our internal appeals procedure.
If you wish to have your case independently assessed, please be advised, there is an
independent appeals service (POPLA) which is available to motorists who have had an
appeal rejected by a British Parking Association Approved Operator. Contact information
and further information can be found enclosed. See also www.popla.co.uk
By law we are also required to inform you that Ombudsman Services (www.ombudsmanservices.org/) provides an alternative dispute resolution service that would be competent
to deal with your appeal. However, we have not chosen to participate in their alternative
dispute resolution service. As such should you wish to appeal then you must do so to
POPLA, as explained above.
Please note, if the Parking Charge was issued in Scotland/Northern Ireland, only the
driver can appeal to POPLA (Parking on Private Land Appeals).
As a gesture of goodwill, we have extended the discount period for a further 14 days from
the date of this correspondence. If you appeal to POPLA and your appeal is unsuccessful
you will not be able to pay the discounted amount in settlement of the Parking Charge,
and the full value of the charge will be outstanding. If you have already paid the reduced
amount, the Parking Charge will be increased to the full amount and the remaining
balance will be due.
Thank you

Arrgh, sadly you didn't use the template appeal from this forum, you used the terrible one in the MSE parking tickets guide that is seven years out of date. No-one should ever be writing about no pre-estimate of loss.
You are now at POPLA stage but should simply try PLAN A first instead of rushing in a losing POPLA appeal (see Newbies thread).Any reason for overstay? Disability?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

PE's signs are pants, read this and complain to your MP.

I'll look at newbies thread and try plan A. Thank you so much for your help.0 -
Not related to the actual charge but next time park in the council owned Linacre road. Ignore the "residents parking only" big signs as there's no actual Residents permit parking scheme in place! Then simply walk through the big gates which lead through to the former bingo hall & The Range etc. You access Linacre road a different way so use Google maps to help navigate round.1
