One last thing…..the boiler room conveyancers say that this is a sale rather than a transfer so the extra 3% applies. This is despite my informing HMRC I was buying from my wife.
is there any difference between a transfer and a sale? Surely a sale equals a transfer for a consideration?Sorry to appear thick I am not used to this sort of 5hing and am extremely grateful for your kind help0 -
They seem to be talking rubbish. SDLT is a tax on “land transactions” and is assessed on the “chargeable consideration”. It is not helpful to the SDLT analysis to try to distinguish here between a transfer and a sale.1 -
Just to update this, SDLT geek was right and the boiler room conveyancers now agree that it’s all at standard rate
