Help please re claim for compensation

He. Applogies if this is the wrong forum for posting this message.  While staying at a holiday rental house a family member stepped into a rabbit hole that was in a child's play area and broke a bone in her foot.
We submitted a claim in September 2021 and the insurance company admitted liability in Novemer 2021.
They asked for information on the injury and the details of the person who was injured. It was a 12 year old girl. We haven't heard anything back since this information was submitted and when I contacted the company they deny receiving the information and have now confirmed that as the claimant is under 18 years old we will require legal representation.
It's a bit late in the day to tell us this, but am I allowed to carry on with the claim as a " Litigation Friend".
Its my son's partner's daughter. I have read that Court attendance will be necessary to approve a settlement and a Solicitor will be required at this stage.

Can anyone please tell me if this is correct?

    Does their home insurance or travel insurance have legal cover? That'll be the best route

  • As above - household legal protection is a viable route, typically this will provide legal fees between 50-100k

    I'm intrigued by this.  Firstly, that the insurance company admitted liability.  Liability for what - not shooting all the rabbits, thereby removing the risk of rabbit holes?  Secondly, what are you claiming for?  Medical fees - surely covered by the NHS?  Loss of earnings - for a 12 year old girl?
    I apologise if this sounds unsympathetic, it's not intended to be.  I'm more curious as to what your basis for a claim will be when asked by the court.

    Same as most injury claims... pain, suffering and loss of amenities aka general damages. The other items you list are special damages but I imagine it is difficult to do your paper round with a broken foot so there could well be loss of earnings.
