Appear to be one and the same - but the price difference is HUGE

Is the Ebay one - a bargain or am I missing something ?

The Amazon one seems to specify it is new whereas the ebay one does not.  Doesn't say it isn't new, but it just doesn't say.  But the ebay one also says there's no returns accepted.

Ebay one says

"New: A brand-new, unused, unopened and undamaged item in original retail packaging"

Is that lawful ?

Surely - if faulty - I can return it ?
