In this case the vendor said they had not carried out any alterations. Even if this statement was untrue, it has not in itself led to any loss by the OP. Any loss suffered by the OP is due to them not thoroughly checking the condition and construction of the utility.
Further, the OP only has the neighbour's word that the utility was erected by the vendor (which is hearsay). Would the neighbour be prepared to sign a statement to that effect. As the neighbour was "sorting out probate" was he the actual occupier at the time the utility was built. although he could have been a resident adult child of the previous occupier.
