Also can I take them to court? How would that effect my credit rating? Can I threaten them with that?
What would you take them to court for exactly

I wouldn’t exactly be claiming anything other than to have the ticket cancelled. I was just thinking of other options where I have more control over the situation and where my credit score isn’t threatened. Is it not a viable option?

This is an ongoing problem at PG and even other gym chains. I'm currently helping a friend off-forum who went to their local gym, complied with the signage, uses the gym then left as normal only to discover they have introduced a Tablet to enter VRM. Which isn't mentioned on the Carpark signs in the T&Cs nor is the Tablet signposted in the foyer nor have there been any Emails from the gym advising of this new condition nor did any staff warn them. If they had entered the gym they would have unlikely seen the unsigned Tablet if there was someone stood in front of it walking by it.

I don't know if any of these factors are relevant to your case, but something to consider.  My friend used a gym in South East London or possibly Kent Borders so could well be the same one!?!

This is all pretty relevant to my case except I actually did use the QR code to register my vehicle but as the system was new I don’t think it worked and that’s why I got a ticket. I’m not sure if it’s worth emailing Trace now and making an informal appeal? I personally think they’d be crazy to actually take this to court but from the threats it looks like they aren’t backing down.

Yes that is the gym I was at too! I’m trying to get written statements from people who have posted on social media but everyone’s case is different and I’m struggling to get one to support my case of the system being faulty.

The fourth post of the NEWBIES tells you why it is safe to ignore powerless debt collectors such as Trace. Emailing them will be a waste of time. They can't take you to court, so forget about them and forget about contacting them.

Your beef is with the gym who, as principal employed the unregulated parking company, and with the unregulated parking company themselves. At this stage nobody else is involved.

You don't need yo waste time speaking to the collectors (Trace) as they aren't interested nor have the authority anywhere to cancel the invoice.

Deal with the organ grinder (the parking firm) and not the monkeys!

I don't think Countrywide are particularly llibellous so the threats of court may just be hot air to scare motorists into paying them.  Even if you can't get statements - take several screenshots to evidence that this is a common recurring problem.  Also get shots of all signs (and lack of) - especially ones which do NOT mention the requirements to scan in!

They ate threatening to take you to court for breach of contract - they stste the contract is their sign, but how can you breach a term that is not listed on there!?!?  That's the key angle my friend js going for along with lack of signs, video and pictorial evidence.  I'll tell them to start taking screenshots too.

Please don't take laughable debt crawler letters seriously.  No contacting them.
