TERMS AND CONDITIONS for “Arden University – KISS Competition” (the “Competition”).

 

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside  our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail. 

 

1.Entry ROUTES and Costs	Entries are restricted to one (1) entry per person.   Entry to the Competition is available via the following routes:   (A)     Online at kissfmuk.com     Online entry  is free of charge.
2.COMPETITION MECHANIC AND HOW TO WIN	There will be one (1) winner of the Competition. All valid entries will be pooled together and the prize winner will be the person who is selected by electronic random draw and successfully answers the entry question
3. ENTRY PERIOD	Entries must be submitted during the following entry period:   From 28th February at 00:01 (the “Start Time”) to 12th March at 23:59 (“End Time”).   Entries received before the Start Time or after the End Time will be invalid.   If the winner cannot be contacted within 3 days from the date of the initial contact from Bauer Media, then we will re-draw until we draw a winner that we are satisfied (in our sole discretion) fulfils all of the eligibility criteria and is in compliance with these Terms.
4. ENTRY RESTRICTIONS	Open to UK residents aged 18 years or over on date of entry. Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter. We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria of Bauer Media, highlighted in section 4. Entry restrictions, in Annex 1 and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms. You must not have won a prize that is valued at £500 or more in the last 6 months from any of Bauer’s competitions..
5. THE PRIZE	One (1) winner will receive the following prize (the “Prize”):   Arden University tuition Fee Sponsorship Offer – enabling students who meet the certain eligibility criteria to receive a 100% discount on their tuition fee for their Eligible Programme provided by Arden University.   The Prize is provided by Arden University (the “Prize Provider”). We (Bauer Media Group) are not responsible for any aspect of the Prize, including unsatisfactory quality, late delivery or a prize winner being unable to take up any aspect, or the entirety of the prize due to their own circumstances or restrictions.   Prizes are non-transferable, non-refundable and no cash alternative will be offered. Please note: that a winner must pass the additional eligibility criteria from Arden University highlighted in Annex 1.

 

 

 

 

 

 

OTHER CONDITIONS

 

1. DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize.  Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 1. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

 

1. MISCELLANEOUS.

 

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.
• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.
• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.
• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.
• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.
• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.
• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

 

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.

Terms and Conditions for Arden University’s KISS Tuition Fee Sponsorship Offer

Effective from 28/02/2022 to 12/03/2022 – The Competition Period.

 

These terms and conditions, together with Bauer’s Specific Competition Terms and Conditions and Bauer’s General Competition Terms and Conditions (the “Terms”) form the basis on which Arden University Limited (“Arden University” and/or “we”/“us”) operates the “KISS Tuition Fee Sponsorship Offer” enabling students who meet certain eligibility criteria (“you”/“your”) to receive a 100% discount on their tuition fee for their Eligible Programme provided by Arden University.

These Terms should be read in conjunction with our main terms, policies and procedures (“Arden Policies”), in force from time to time, including but not limited to:

 

• Arden University’s Terms and Conditions (“Main Terms”);
• Arden University’s Privacy Policy
• Arden University’s Course Fee Payment Policy;
• Arden University’s Refund Policy;
• Arden University’s Student Protection Plan; and
• Arden University’s Student Regulations.

Copies of all Arden Policies are available on the Arden University Website.

For the avoidance of doubt, you remain bound by the financial and contractual obligations of the Arden University terms and conditions applicable to your Enrolment on your Eligible Programme (as defined below) as appropriate.

 

1. 1.          Definitions

1.1.        “Applicant” means an individual who has applied to study for an Eligible Programme.

1.2.        “Cancellation Period” means the period of 14 days starting the day after the Programme Start Date.

1.3.        “Eligible Programme” means any foundation + undergraduate course, any undergraduate course and any postgraduate course offered by us.

1.4.        “Enrolled” means the process of formally registering your participation in the Eligible Programme and the expression “Enrol” and “Enrolment” should be read accordingly.

1.5.        “Fee Liability” means the amount that you are obliged to pay for your Eligible Programme (as if the KISS Tuition Fee Sponsorship Offer was not applied) once your acceptance of your place has been confirmed by us;

1.6.        “Module” means an individual, self-contained element of a Programme;

1.7.        “KISS Tuition Fee Sponsorship Offer” means the opportunity to study for an online degree or postgraduate with no tuition fees in accordance with and subject to these Terms and meeting the entry requirements for the Eligible Programme chosen;

1.8.        “Programme” shall mean any course at any level (e.g. foundation, undergraduate or postgraduate) offered by us and, for the avoidance of doubt, shall include the Eligible Programmes;

1.9.        “Programme Fee” means the total published tuition fee to be paid to us for a Programme from time to time and any fees, costs or expenses which are not tuition fees are expressly excluded. For the avoidance of doubt, the following items are outside the scope of the Programme Fee (without limitation): costs relating to accommodation, living, food, subsistence, travel, stationery, computer or computer equipment, registration, or Enrolment; other fees charged either by us, any of our partners and/or any other governing or regulatory body in connection with your studies; library charges; printing charges; and costs associated with retaking any assessment;  

1.10.     “Programme Start Date” means the start of your Eligible Programme as defined in Arden University’s academic calendar (excluding induction Modules);

1.11.     “Sanctions” means any sanction, including but not limited to, economic or financial sanctions or trade embargoes, that is imposed, administered or enforced from time to time by (a) the United States government (including, without limitation, OFAC), or (b) the United Nations Security Council, or (c) the European Union, or (d) Her Majesty’s Treasury of the United Kingdom;

1.12.   “Sanctioned Person” means, at any time, (a) any Person listed in any Sanctions-related list of designated Persons maintained by the United States government (including, without limitation, OFAC), the United Nations Security Council, the European Union, or Her Majesty’s Treasury of the United Kingdom, or (b) any Person controlled by any such Person; and

1.13.     “Website” means www.arden.ac.uk.

 

1. 2.                     Eligibility

 

2.1.        To be considered eligible for the KISS Tuition Fee Sponsorship Offer you must meet the following criteria (the “Eligibility Criteria”):

2.1.1.      You are a UK resident aged eighteen (18) years or over on date of entry.

2.1.2.      You are not an employee (or a family member) of any Bauer Media company or employee of any company involved in the competition in any capacity, including the prize provider.

2.1.3.      You must not have won a prize through any of Bauer’s competitions, within the last 6 months of your entry date at or over the value of £500

2.2.        Notwithstanding the fact that you satisfy the Eligibility Criteria, you will cease to be eligible for the KISS Tuition Fee Sponsorship Offer if any of the below apply and you will become immediately liable for the full Fee Liability:

2.2.1.      you have previously been sent an offer from Arden University to study a Programme;

2.2.2.      you do not Enrol on your Eligible Programme by 31st December 2023;

2.2.3.      you cancel your place on your Eligible Programme (see paragraph 4 below); or

2.2.4.      you accept an offer to study a Programme which is not an Eligible Programme; or

2.2.5.      you are withdrawn or you withdraw from your Eligible Programme (see paragraph 4 below); or

2.2.6.      you transfer your place to a Programme that is not an Eligible Programme (see paragraph 5 below); or

2.2.7.      you applied to study your Eligible Programme through an agent; or

2.2.8.      you are or become, an employee (whether permanent or temporary), or a family member of an employee (whether permanent or temporary), or an agent, of (a) Arden University or any of its associated, affiliated or subsidiary companies, or (b) an Approved Arden University Franchise Partner or (c) any other Arden University partnership companies or (d) any companies involved in the Global Freshman Certificate; or

2.2.9.      any part of your application for your Programme place or any information subsequently provided to us in connection with the Kerrang Tuition Fee Sponsorship Offer (including, without limitation, any financial information) is misrepresentative or fraudulent; or

2.2.10.   you are a Sanctioned Person.

2.3.        For the avoidance of doubt, the KISS Tuition Fee Sponsorship Offer does not apply to if you carry any credits from any previous learning at another institution i.e. RPL/APL/APEL students are not eligible for the KISS tuition Fee Sponsorship Offer.

2.4.        For the avoidance of doubt, the KISS Tuition Fee Sponsorship Offer does not apply to (a) Approved Arden University Franchise Partner students i.e. Approved Arden University Franchise Partner students are not eligible for the KISS Tuition Fee Sponsorship Offer; (b) Global Freshmen Certificate students; and (c) students who are Arden students through any other Arden partnership arrangement.

2.5.        If you become ineligible under these Terms at any time during your Eligible Programme, you will become immediately liable for the full Fee Liability.

 

1. 3.                     Application of the KISS Tuition Fee Sponsorship Offer

3.1.        To apply for the KISS Tuition Fee Sponsorship Offer, please see Kiss Terms and Conditions section 1 to 4.   our application will be assessed against the Eligibility Criteria and awarded in accordance with the Eligibility Criteria and the Terms.

3.2.        If awarded the KISS Tuition Fee Sponsorship Offer, it will be allocated automatically to you once you are in receipt of an offer for an Eligible Programme from us and will then be applied once you have accepted that offer to study at Arden University.

3.3.        For the avoidance of doubt, the KISS Tuition Fee Sponsorship Offer will not apply to any other costs associated with your participation in the Eligible Programme.

 

1. 4.                     Cancellation and Withdrawal

4.1.        In the event that you are awarded the KISS Tuition Fee Sponsorship Offer and you subsequently cancel or withdraw your place on your Eligible Programme you will forfeit your KISS Tuition Fee Sponsorship Offer.

4.2.        The KISS Tuition Fee Sponsorship Offer is subject to cancellation in accordance with paragraph 6 of these Terms.

 

1. 5.                     Transfer, Deferral and Leave of Absence

Transfer

5.1.        If you transfer from your Eligible Programme to a Programme which is not an Eligible Programme, your KISS Tuition Fee Sponsorship Offer cannot be transferred, and you will no longer be eligible for the KISS Tuition Fee Sponsorship Offer. Our Finance team will confirm to you by way of email your Fee Liability for the Eligible Programme and your new Programme.

Deferral

5.2.        As an Applicant, you can defer the start of your Eligible Programme before your original Programme Start Date a maximum of two times provided that the Programme Start Date for each deferral starts on or before 31st December 2023.

5.3.        Once you are Enrolled, you can defer before the end of the Cancellation Period and only once, provided that the Programme Start Date of such deferral starts on or before 31st December 2023.  

Leave of Absence

5.4.        If you wish to take a leave of absence from your Eligible Programme after your Programme Start Date, please see our Leave of Absence Policy on our Website.

5.5.        During your leave of absence, the KISS Tuition Fee Sponsorship Offer will still apply to your Eligible Programme. If you subsequently decide to withdraw or are withdrawn, paragraph 4 will apply.

 

1. 6.                     Cancellation by Arden University

6.1.        For the avoidance of doubt, we reserve the right to refuse or to withdraw an offer or to cancel your accepted place on an Eligible Programme for any of the reasons set out in the Main Terms, and including (without limitation) in the following circumstances:

6.1.1.      insufficient student numbers confirmed on your Eligible Programme; or

6.1.2.      if the number of students confirmed on your Eligible Programme exceeds the number of places available; or

6.1.3.      if the running or continuation of your Eligible Programme becomes unviable or practically impossible for Arden University.

6.2.        If we are unable to run your Eligible Programme or cancel your place for any reason as set out in the Main Terms, including (without limitation) the reasons listed in sub-paragraphs 6.1.1 to 6.1.3, we will give you the opportunity to transfer to a different Eligible Programme subject to there being a place available.

 

1. 7.                     General

7.1.        The KISS Tuition Fee Sponsorship Offer cannot be combined with any other offer, reimbursement, rebate or credit offered by us.

7.2.        The KISS Tuition Fee Sponsorship Offer is awarded at our sole discretion and our decision will be final.

7.3.        We reserve the right to withdraw or amend the terms of the KISS Tuition Fee Sponsorship Offer at any time.

7.4.        You understand and acknowledge that the Eligible Programmes are subject to availability and numbers of applications received by Arden University and that we may cancel any of the Eligible Programmes prior to accepting applications or following acceptance of applications for a new intake. You will be informed of this at least 6 weeks prior to your Programme Start Date.

7.5.        You may not transfer any of your rights under these Terms to any other individual or entity.

7.6.        Nobody else has any rights under these Terms. These Terms are between you and us. No other person shall have any rights to enforce any of their provisions.

7.7.        We may transfer our rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under our relationship. If you are unhappy with the transfer you may contact us to terminate the relationship within 30 days of us telling you about it.

7.8.        We will not be liable to you in respect of any claims or losses arising from these Terms and the KISS Tuition Fee Sponsorship Offer. The above limitation of liability shall not apply to any claims that relate to death or personal injury through our negligence.

7.9.        If we delay in carrying out our obligations to you under these Terms caused by circumstances beyond our reasonable control, then we will not be liable to you (or any other person) for the consequences of that delay.

7.10.     If we delay in enforcing any of these Terms, we may still enforce any of them later. If we do not insist immediately that you meet your obligations under these Terms, or if we delay in taking steps against you in respect of your breaking these Terms that will not mean that you do not have to do those things and it will not prevent us from taking steps against you at a later date.

7.11.     If there is a conflict between these Terms and the Arden Policies or any other terms issued by us relevant to the Psychology Scholarship, then the Arden Policies shall prevail, except in the case of a conflict with clauses 5.2 and 5.3 where the clauses shall prevail over the Arden Policies or any other terms issued by us relevant to the Psychology Scholarship.

7.12.     For the avoidance of doubt, if your KISS Tuition Fee Sponsorship Offer is revoked, you will be liable for the Fee Liability for your Eligible Programme.

7.13.     Each of the provisions in these Terms operates separately. If a court finds any part of these Terms unlawful, the remaining provisions will continue in full force and effect.

7.14.     We will at all times process any of your personal data in accordance with our Privacy Policy which is compliant with UK GDPR and the Data Protection Act 2018. Our Privacy Policy is available on our Website or upon request. 

7.15.     These Terms are governed exclusively by English law and both you and us irrevocably submit to the exclusive jurisdiction of the English courts for any claim arising under or in connection with these Terms and any non-contractual obligation arising out of or in connection with them.
