Company unable to deliver but charge in the £100's for non delivery

  • Most of these types of delivery in my experience are for delivery to the kerbside only or make the customer responsible for determining whether their drive is suitable. check the t&cs to see what they have included.
    I have lots of deliveries that are roadside only, and we trolley stuff down, it's not the suppliers fault that we have a non standard driveway. 
    whoops, i did put drive, its a tarmac road. so drop off is kerbside, this road then leads to other houses

    • Ensure the delivery area is flat and solid enough to take the weight of a pallet truck carrying up to 1 tonne in weight.
    • Please notify us of any delivery constraints in advance, example, weight limit, tight street access. If the vehicle is unable to deliver due to access, your order may be returned to us or the carriers depot where storage charges and redelivery charges may be added.

    I agree, clear enough, i would copy email on here, but not sure how to do it, but the terms are as i stated.

    Also, having looked at their website and their T&Cs, especially under delivery (evanstransportation in North Devon?) then they only mention about charges if the goods cannot be delivered in a timely manner, and nothing about delivery requirements.

    In which case, I think it would an unfair T&C to expect you to pay as you would not be expected to know the requirements for a 26 tonne lorry, nor did they give you any guidance to the restrictions.
