Speeding - Fixed penalty or court summons?

Someone I know was caught by a mobile camera van @ 45mph in a 30.  Reading the notice of indented prosecution it states that the threshold for a speed awareness course extends only to 42mph or 43mph (I forget which, but either way it was below 45).

Will this automatically result in a court summons or is there a chance it could still be dealt with using a fixed penalty?

  • Her 1st ever. Annoyingly due to forgetting the braking point where limit changes from 50 to 30 entering our village!

  • Makes no difference how many offences unless the three points would take the driver to 12 or more, when a fixed penalty would not be offered. Courses are normally offered up to 42mph and fixed penalties (£100 and 3 points) up to 49mph in a 30mph limit. The various thresholds can be found in section 9 of this document:

    Fixed penalty is usually offered up to 50mph in a 30 limit.

    Personally, I'd be telling her to watch her speed. 45mph in a 30 is ridiculous.
