CST LAW LBC REPLY FORM

I have a LBC from CST law. I live in scotland. The registered keeper was not the driver of the car at the time of the fines.

There are 6 in total.

I have sent an e-mail to CST with no reply and also i have a reply form. Do you i send this back with the relevant information or do i just ignore it?

    Please PM a board guide and ask them to move this thread to the Parking board.

    Were the alleged contract breaches (they're not fines or penalties, so not offences) also in Scotland? Does the LBC mention making a Simple Procedure claim (or does it mention a County Court claim)?

    It doesn't mention anything about what type of claim it is...

    If the registered keeper was not the driver are they able to take this to court?

    In England - yes. In Scotland - no*. (At least not yet, but that will change as Wee Jimmy has foisted POFA on us, to become effective when the Parking Bill becomes fully effective).

    * Well they can - they can assume the keeper was the driver and try a claim that way, but they would have to prove that the keeper was the driver. But they can't hold the keeper liable for the charge as keeper.

    What exactly does the LBC say (exact words) regarding the outcome if the recipient fails to pay the amount demanded in the LBC?

    PS - to answer an original question - you do NOT need to complete and return the reply form.

    PPS - have you asked a board guide yet to move this thread to the Parking board?

  • it says "In the event of the debt not paid in full we are instructed to commence legal proceedings. Our client is satisfied that it has sufficient evidence to support this claim and if necessary we will rely on this evidence in court. please pay or reply within 30 days of the date of this letter. Any reply received outside of the 30 day period may not be considered as legal proceedings are likely to have been issued".
