Sim card contract with O2 Question?.

My Broadband/landline/simcard/tv contract with Virgin Media was coming to an end in March 22. Back in January I got an email from Virgin saying that they were going to raise the price of my package by £4. Read an email from this site saying that I could use this to renegotiate my package and as it was coming to and end anyway I contacted Virgin Media. This resulted in me actually getting the same package with an upgrade to the TV channels and changing my wife's sim card from Virgin to O2. As I was paying around the same as previously I was quite happy with the deal. The contract started from the 10th of February, the change of sim card to O2 went ahead and all was well for another 18mths or so I thought until yesterday when I received an email from O2 saying that unfortunately they would be putting up the monthly price of my wife's simcard due to the 7.8%RPI and the annual 3.9% rise.

               Firstly is this classed as a breach of contract and can I use it to cancel the O2 sim card contract but keep the Virgin Media package?. Did a quick check on sim card contracts this morning and I can actually get a better deal at several other providers including Virgin as my wife uses her phone for texting and talking and has very little to no need for a large data package. Appreciate any advice offered.

    If it was written in the T&Cs when you signed up that your prices will increase by CPI+3.9% then it is not a breach of contract because that's what you agreed to.  Is the simple answer.

    Many other supplier's will also be putting their prices up shortly so even if you were able to jump without penalty you would probably be hit by their annual increases. Your Virgin Mobile (via EE) sim would have been going up by the same CPI+3.9% (although in that case you may have had the option to leave without penalty).
