Mum's tree fell on neighbours car!

    In the first instance the question is would an average person see there is a problem with the tree? If the answer is yes then an expert opinion may be useful to know how quickly such a condition would have developed over. The average person doesn't do formal inspections of their properties but in theory you should do at least a periodic check and in particular of land that's detached from your main dwelling.

    She's only responsible if she's been negligent.

    When my neighbour's tree was obviously in a bad way, I made sure to write to him saying so.  When the tree came down, he had to pay for my fence.
  • Thanks for all the replies/comments etc. I'm going down to darkest Kent next Monday with a chainsaw and cutters to chop it all up and sling it back over my Mum's fence. The neighbour's insurance assessor came on Monday & no mention of liability on our side, as yet!

    If you mean the third party's then almost certainly he is an engineer looking at if the vehicle is a total loss etc rather than liability.
