Unfortunately this is correct. That doesn't mean that the current signs are adequate. You aver that they are not and make the PPC prove otherwise. Signage is not the only appeal point either.

It was a successful appeal against a Lamorna Cove ticket. The NTK was non-POFA compliant because it did not invite the keeper to pass the NTK on to the driver. There was therefore no keeper liability.There were lots of other grounds in the appeal as well, including poor signage, but the assessor didn’t need to consider those.8 -

@Handbags-at-dawn thank you for your post, it was enlightening reading, especially when the NTK that came through doesn't include paragraph 9 (2) (e) (ii) words 'and pass the notice on to the driver." I'm hoping that in itself will be enough for a successful POPLA appeal by not being PoFA compliant (?) but will definitely include frustration of contract, loading not parking and signage issues to start -thank you @Fruitcake for the numerous suggestions. Still need to read up on some of the other lingo - authority of landowner, standing charge etc and the charge notice includes times and has ANPR pictures too, so will research appeals against those things further as well to get it nice and wordy.
Interesting reading of the great wordy examples of POPLA appeals on the NEWBIES thread too!
Just double checking, the PPC online appeal is only the 'one size fits all' template on NEWBIES. It's very generic but I'm presuming that's deliberate at this stage. Although it states a complaint will be made to the landowner re predatory conduct - does this step need to be followed if the landowner apparently ignores all appeals? Or just take out of the template wording for this appeal?

It's easier to send the initial template as is than to start fiddling with it unless you are going to add something like, the NTK was non-PoFA compliant, ensuring of course that the driver is never identified.
Always complain to the landowner no matter what. If enough people complain, they might get fed up and actually do something about it.
The same applies to MP complaints.
Nine million PCNs were issued in 2019 before Covid stalked the land. That's nine million potential votes (plus family members) lost or won if everyone had complained. I do find it strange why they haven't sorted the wording on their paperwork accordingly when such simple errors can make them non-PoFA compliant?? 🤷♀️🤷♂️0 -
Can I ask if you successfully wrote to the landowner? It seems it went up for sale in 2018 but didn't sell. Then another article from August 2021 that it went up for sale again but can't find anything about it selling. Nice email from Premier Park today. Saying tell them who the driver is or they won't speak to RK until 17th March when they make their appeal decision.....😭
