ANPR PCN


This time it's from anpr system. I received a PCN from Secure Parking Solutions for unauthorised parking in a car park they manage for Duncan James. I went to visit a restaurant nearby and this car park was right next door. I was not familiar with the area and entered the car park. It was around 6pm and dark. The signs were difficult to see and it was a weekend so assumed ok to park there. After parking I went to the restaurant and they Informed me that it wasn't their car park and there is another one nearby which I should use. So i quickly went back to my car and moved it out the carpark.
This was probably all done within 10mins which I belive is the BPA grace period??
I appealed using their online system which was rejected and now I am at Popla stage.
This was my appeal which i am disappointed with, I saw some examples on here and used.
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner. There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and an explanation of the reason for the PCN, because your Notice does not explain it. The images of the signboard are not clear, difficult to read especially at night. According to your notice to keeper this vehicle was observed for less than 3mins which i feel is not sufficient time for a vehicle to enter, road terms and exit. The signboard you have provided states 'customer use' but does not provide sufficient details of your client. A very unclear sign. I find it ridiculous that you have issued this notice after 3mins of observing the vehicle.
I'm not sure how exactly these anpr systems work but if anyone has any good advise on popla appeals that would be appreciated. And yes I have been on newbies thread and currently looking at some examples, I am trying to find an anpr one which is relevant to this case. The parking company have given images as evidence of my car and some of the signs but the images of the signs are from a later date in the daytime so it doesn't show the real image of the signs at night. It's a little far from me so I don't have images of carpark from the night.

If they are using ANPR it should follow the BPA Code of Practice - you can google it
General principles30.1 You may use ANPR camera technology to manage, control and enforce parking in private car parks, as longas you do this in a reasonable, consistent and transparent manner. Your signs at the car park must tell drivers thatyou are using this technology and what you will use the data captured by ANPR cameras for.
This is also a requirement of the Data Protection Acts
....So I think this doesn't comply.1 -
