Problems with Samsung Cashback Pre-Christmas Offer £80

Before Christmas Samsung were offering £80 cashback on the purchase of some mobile phones. They will not give me my cashback.
To be eligible it had to be the right product and purchased from an approved supplier. Lists were displayed on their website.  I looked carefully at both the lists of products and especially at the list of suppliers that were participating in the promotion, and found several listings for Amazon as being an approved supplier. 

I went to Amazon and purchased a Samsung A52 as a Christmas gift.  There is no way I would have found the cost for the phone if I didn't think I was going to get the refund of £80.  In addition, there were several cheaper prices elsewhere that I could have gone to if I had not believed I was going to get cashback.  Just to double check, I phoned Samsung to confirm before I placed the order.   

However, my refund has been rejected by Samsung as they say the phone was not purchased from Amazon but fulfilled by a third party.  The page on which I found the phone had a link to Samsung - but did NOT state that the phone was not going to be fulfilled by Amazon, but by a third party. Even when I clicked to put it in my basket it did not list a seller's name which might have alerted me.    All the time - I fully assumed I was buying from Amazon. The way they advertised the phone is very misleading. 
 Samsung won't help, because although Samsung had a printed list of sellers that were eligible - there is apparently small print underneath (point 13 apparently) which says items purchased from an auction site such as ebay or Amazon aren't eligible.  But it appeared to me that I was buying from Amazon and not an auction sight.  I think it was very misleading.

Amazon refuse to help because they say if there had been an offer it would have been on the page.  But the offer was made by Samsung - not by Amazon - so I was not expecting an offer to be on their page.  Furthermore Amazon say that at the point I paid, it would have displayed the name of the company selling.  But in the pre Christmas rush - and having ordered literally hundreds of things from Amazon in the past - I just clicked pay at that point. 
I feel very cheated by Samsung because I felt having scrolled through pages of potentially liable vendors - the small print was lost to me and even now is not very clear to understand. 

 I feel cheated by Amazon - who I feel did NOT clearly list the name of the actual seller on the advertising page - nor when I clicked to put it in my basket.  
I feel both have let me down and I feel very cheated. Has anyone got any ideas?

    Paste a link to the item you bought.  If it's no longer sold on Amazon, can you paste the order confirmation, blanking out any personal details and the order number, of course.

    What resolution do you want?  Samsung don't owe you anything if it doesn't meet their promotional terms - they've done nothing wrong.  All Amazon owe you is a refund if they misled you in the sales process, but given that this was a gift, are you in a position to return the phone to them, because they don't have to refund you without that.

    Unfortunately it won't let me post a link.  But it was apparently fulfilled by Only Branded.  That is not clear.

    I could not return it as my husband opened it on Christmas Day and the return T&C said it couldn't be returned if opened.

  • It seems its a expensive lesson in reading the small print - and making sure you understand every word.  I still feel misled.  But accept there is probably nothing that can be done.  I thought I had done everything correctly.

    I know it doesn't help you now but it does seem that Amazon themselves sell very few items directly these days with the majority of things sold being from marketplace sellers, often then fulfilled by Amazon. If you need to buy directly from Amazon in future once you have searched for an item, click through to the correct department on the left hand side, then scroll down and it gives you the option to choose the seller, click the box for Amazon and it should narrow down your search to all Amazon direct products, they do still add sponsored items from other sellers though so you still need to double check.

    I had a £10 voucher off a £30 spend in December that could only be used on Amazon direct items and it took days of searching to find things that I actually wanted, were a reasonable price, and actually from Amazon rather than a third party.

    The product identifier used specifically on Amazon's site is the ASIN (Amazon Standard Identification Number). ASINs are 10-digits long and include letters and numbers. Every product sold by Amazon and its affiliates has an ASIN. Look in the product’s URL in the address bar of your browser to find the ASIN of your chosen item (it will appear after the item name and “dp”).

    For example I have just looked for a Samsung phone (any phone) being sold by Only Branded and fulfilled by Amazon.
    I found this:

    If you look after /dp/ you will see the 10 digit number B08TF7VKR1. That is the number which Aylesbury_Duck is asking for. Look for that number for your phone.

    By the way, you have got mixed up about who you bought it from. The seller is Only Branded. The sale is fulfilled by Amazon. That means that Amazon carry Only Branded's stock in their warehouses and deliver them when someone places an order, rather like DPD or Royal Mail.
