I was left half share in a house but didnt go on title deeds

I'm in need of some advice 5yrs ago my mother passed away and myself and my sibling were left her house in the will,but only my siblings name was on the title deeds now my sibling recently passed away and it would seam they owe money to a bank and other companies, at present i haven't done probate because of the debt situation but I'm now been pestered by the bank but ive told them there is no estate, but i am told they will search probate and land registry and obviously there name will come up at the L/R for the property which ive lived in since my mother died but will the bank recognise that the my sibling only owned 50% of the property if i showed them a copy of said will,and what are my rights before i do probate? money owed to the bank is under £5000

    how did just your siblings name end up on the land registry? who did the probate at the time of mum's death?
  • i was ill at the time it wasn't an issue for me then, both our names are on the probate.

    it sounds like the land registry needs to be corrected! unfortunately as it stands it will look like your sister owned the property solely. Was a solicitor in registering the property in your sister's name?
  • no solicitor was involved, so could i get InTouch with land registry and explain that I'm on the probate as well ?

    As executorship of the estate you'll be personally liable for any unpaid debts. Lying is committing fraud. You are walking a fine line. Suggest you consult a solicitor and deal with the matter properly. Before the wheels fall totally off and you do/say something you later regret.

    Agree need to speak to a solicitor - something went wrong when the property was registered in your sister's name - strange thing to have happened if you had both been left it in the will (or was there a financial advantage at the time in not owing it?)
  • no financial reason i just didn't really want responsibility of owning property, you say im responsible for debts but there is no money just the house so at worse what can the bank do if im living in the property surely they cant make me sell for a measly 5k

    As the other posters you need legal advise ?  

     Have a look on Rightmove and see what neighbouring properties and see what it might really be worth ?

    some people may avoid taking on a property as it affects benefits but sounds like this was not the case. 

    unfortunately as it stands with the property in your sister's name, the estate is not insolvent  and the estate would be expected to pay the debts - are you in line to inherit from your sister or has she got children, a spouse or other siblings?

    no siblings or spouse just me.so if I'm expected to pay the debts back it would have to be in instalments
