Heathrow Drop Off fee - appeal

Hello, I've recently had my appeal to APCOA rejected for non payment of the Heathrow drop off fee. I was not driving the car and used the standard template (amended as required) from the newbies thread. They've rejected the appeal outright but  frustratingly not even bothered to answer my questions/requested for evidence of the signage. Has anyone had any success appealing this particular fine to POPLA?

    If you check the announcements on the first page of the forum, you will see one marked POPLA decisions, read those from the end backwards or use the forum search tool.

    You can't lose!  This is easy and you are about to win.
    I think you have overlooked the fact that ALL 'registered keeper/non-POFA' appeals to POPLA v APCOA win 100% of the time and you just need to copy an Airport APCOA POPLA appeal. Either search the forum for one, or try Googling to find one.

    Did you do your POPLA appeal in time?  As ParkingMad said, a keeper can't lose v APCOA as long as you use the usual 'non-POFA/not relevant land' argument and state you were not driving.

  • Hi, I have been reading through the thread of the PCN charge by APCOA. I am currently dealing with the same issue for a visit by friend who used my car. It was the first time my friend visited Heathrow with this new changes. So my friend had to go through the drop zone twice but didn't stop to drop because it was all confusing and final got back in to drop off. One payment was made as that was for the actual drop off.

    As the  registered keeper of the vehicle APCOA sent me the PCN.. I have informed APCOA that I was not the driver and informed them that the drop off your paid. They have been requesting for the name and address of the driver which I didn't give them. They have now sent me a letter showing 3 visits, even though it was one actual drop off and APCOA  sent the reference to appeal to POPLA as they rejected my appeal. 

    I am not sure how to approach this and what format to use in writing my appeal. I will be grateful to have your advise and support in addressing this matter.

    It really is a cinch as long as you don't say who was driving and copy a Heathrow POPLA appeal that talks about the fact that this is not 'relevant land' and no keeper liability applies.

    Also point out that the driver was confused/lost in the lanes of rushing traffic and circled round, only using and gaining utility from the drop off bay ONCE.  Attach evidence of paying £5 for the use of the drop off zone.  The other two times the car didn't stop and was through well within the BPA minimum 5 minute consideration period, so PCNs for driving along a lane without stopping were not properly given.

    Also point out that in other POPLA evidence packs seen, re this place, only ONE SIGN out of twenty actually quantifies the £80 as a sum of money, which obviously means the driver has not agreed to pay £80. Onerous penalty clauses must be prominent.  The signs do mention the £5 but that's not the same as prominently communicating the £80 risk, and means the Beavis case is distinguished and there was no contract seen or agreed to pay £80.
