Poorly marked disabled space

Hi all, couldn’t find any information on this specific query in the forum.
My vehicle had a PCN attached to it for “parking in a disabled persons space without a blue badge”. UKPC managed car park.
Few points to note:
- It was dark when the driver parked the vehicle and the lighting was poor. The disabled badge marking on the floor of the bay was so worn that it could not be seen by the driver (I have a photo of this, but not sure if I should attach it here).
- The lines of the bay were white instead of yellow.

- This specific bay shared a side with a taxi rank meaning not both sides were hatched.
In addition to this, the supposed “disabled space”, was further from the door of the location than other spots, so it provided no benefit for the driver to park there.
Is there a reasonable defence here?

This was at Stretford Mall.I spoke to Aldi over email but they said that since they’re not the landowner they can’t cancel, but that they will assist if UKPC don’t cancel the ticket after my appeal.0

Did you appeal and get a POPLA code and still need help?mendTown said:This was at Stretford Mall.I spoke to Aldi over email but they said that since they’re not the landowner they can’t cancel, but that they will assist if UKPC don’t cancel the ticket after my appeal.PRIVATE 'PCN'? Thanks for the reply. I appealed to UKPC but have yet to receive a NTK or a reply to my appeal. I did the appeal at the normal day 26-28 and it’s been nearly a month since then. Is it normal to have heard nothing?Coupon-mad said:

They have 35 days to respond. You might get an interim letter asking you to identify the driver. Ignore that, as it will be followed by a formal rejection of your initial apples around day 35, along with your POPLA code. For POPLA, make sure you have plenty of timestamped photos of the bay and surrounds. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks for the info. If I don’t receive a reply within 35 days, what does that mean?Umkomaas said:They have 35 days to respond. You might get an interim letter asking you to identify the driver. Check your spam and junk emails as the reply may not be by letter.
Also you can try logging in as if to pay on UKPC's website and instead 'view photos'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
