You know they are required to, from your court directions, that you followed. You probably both had the same deadline.
Expect a discontinuance this week. Which PPC and which solicitor?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It is UK Parking Control and DCB Legal.
My deadline for filing my WS is 14th July at 4pm. The case is to be heard 3 weeks later.
The Notification of Allocation that I received has directions for me to follow, however what the claimant must do isn't as clear to me (that doesn't mean much though as many things aren't clear to me!).
It states that they must pay the trial fee by the same date that is my own deadline- 14th July.
It also states they must file with the court copies of the trial bundle at least 7 days prior to the hearing.
It doesn't make a mention of them sending anything to me/filing their own "witness statement".
Thank you...let's hope they discontinue1 -

Does it not state something like "file and serve on each other"?nayfeee said:The Notification of Allocation that I received has directions for me to follow, however what the claimant must do isn't as clear to me (that doesn't mean much though as many things aren't clear to me!).

Hi Le_Kirk,
It states:
"...you must file at Court and serve on your opponent
a) A written witness statement of any person (including yourself) whose evidence is relied upon in support of your case. The statement must....."
The letter makes no reference to them having to serve anything upon me. The only reference to their duties is that they must pay the court fee by 4pm on 14th July (which I have just been informed they are yet to do) and to file copies of the "trial bundle" wit hteh court 7 days before the hearing.0 -
They will have the same instructions as you and they must file and serve on their opponent, i.e. you. I am assuming this is a straightforward claim and defence and not involving a set-side.2

It is a straightforward case as far as I am aware yes. They have not served anything on me yet, I have not received any WS from them and the deadline is approaching. Let's hope they don't pay the fee before the deadline and the hearing hearing is cancelled!Le_Kirk said:They will have the same instructions as you and they must file and serve on their opponent, i.e. you.
