  • The hearing was held remotely by CVP. It was originally scheduled for 12pm today but I got email yesterday afternoon that they changed it for 3pm. I joined the room at 2.55pm and the court staff let me in the room and judge joined exactly at 3pm. He told me that Claimant won't be joining and they ask judge to consider their witness statement. I was surprised as I was certain they will join as it was held remotely. Then judge said he read my witness statement and also the supplementary witness statement which I sent on Monday. In my supplementary witness statement were 3 points. First that they were late with their witness statement by 13 days, second the additional charge and 3rd the contract seemed to be out of date. Judge said that they didn't obey the court order by sending the witness statement by the date set and he will then dismiss the case base on that. The video call lasted 3 minutes and 27 seconds. I didn't ask for any costs as Friday is my day off anyway, maybe I should as I spent money for printing and postage...

    Could you tell us at which court your hearing was held and the name of the Judge please. It helps us build a picture of those courts/Judges who have private parking issues well sussed out.

  • It was against Euro parks/Gladstones. The hearing was at Derby County court, judge Godsmark.

     Have you asked for unreasonable behaviour costs under CPR27.14(2)(g)?  

    If the contract has exipired they have wrongly obtained your data from the ATA.  Complain to them and the DVLA and consider taking them to court for a data breach, read this
