Bensons for Beds wrong mattress delivered, years passed, what are my rights?

    If the mattress came with a 10-year guarantee and you've had the use of a mattress (the incorrect one) for 5 years, would you be satisfied with a 50% reduction off the (proper, not list) price of a new one?  That might be an approach to take, I suspect Bensons will still try to push back.

    I suppose I’m hoping that I would be able to get, in exchange for the wrongly delivered goods, the mattresses I actually paid for.

    Rather convenient to ask now after 5 years use of the mattress...........

    That would be acceptable, I simply want what I paid for. I’m sure they will completely shut me down anyway.

    The OP has by their own admission being living in something of a fog for the past several years, understandably given what they have been through.  How can they be so sure of exactly what they said to the sales person, and what the sales person said to them.  It might appear, if being uncharitable, that the customer actually had 5 years good use from an item and is now seeking to gain advantage by claiming it's the wrong item.

    Ok, I’m out of here, I asked for advice, not OPINION. 
    I’m sure of what I said and what was said back to me. 
    I’m not seeking to gain advantage by claiming it’s the wrong item, I’ve got much more important !!!!!! to occupy my thoughts than a paltry refund. ie. dying.

    Years ago my friend advised me never to buy a bed from Bensons Beds because her daughter had had a terrible experience with them.

    However, the fact that the member of staff said, "it’s just because the showroom mattresses have been used by customers testing them out." is what would really have irked me, unless you got a discount for the fact that the mattresses were ex-showroom stock. Most shops have beds for customers to try in the showroom but send out brand new ones. Unless the customer is specifically told they're getting one of the showroom ones.

    But you have had the mattresses for a relatively long time. How has your husband slept?

    Ok bud, thanks for your opinion, but everything I’ve stated is fact.
    It’s not ‘convenient’, you try living with chemo fog and the impact cancer has on your brain.

    Yes - I was wondering that.  If my wife was so ill with cancer I don't think I'd leave her to deal with this, I'd sort it our for her.

    You would be entitled to a swap to a 5 year old medium mattress, not a new one.

    Presumably, the bed has not been uncomfortable for 5 years.
