  • I received the same standard letter after reporting my fathers passing. I responded to it the same day and with in the week was sent a cheque for £446.00 tax rebate. Obviously we might have owed money which we would have settled from the estate.

    As there is no will the money is your wife's.

    There is nothing to stop her giving her mother's partner a gift of money of how much she wants.

    If you can afford it she could give him the money now as the estate will come to her  when settled.

    it will depend on the amount of state pension she received whether any tax is due.t.


    You could work out roughly by multiplying how mush she get a week by the number of weeks from the start date to the last weekly payment

    SSP is taxable so the amount from 6 April to May needs to be added in.

    Did she get a P45  showing how much was paid up to May?

    She will have her personal allowance of £12570 so if her total income is less than that there will not be any tax to pay.

    if it comes to more than the personal allowance then there will be tax to pay.

    I would think it more likely you were owed a rebate but not necessarily, so basically a waiting game.  So if the partner is struggling then I would think at this early stage give any help you think you can.  I'm sure she would not want to see him struggle more than had to be.  If not struggling then hold your fire until you know what is what.

    The executor of the estate is legally responsible for settling the affairs of the deceased. Worth allowing a few weeks to pass to ensure no loose ends appear. Personal liability remains with the executor. Clawing money back from the beneficiaries isn't always easy.
