I got a quotation for hard landscaping my garden. Large patio, paths and base for shed. The price was agreed and a firm date given for the work to be done. I was asked to pay 10% deposit to secure the date/work slot.
Twice now this tradesperson has changed the start date which I am not happy about as he cannot even confirm the 3rd date. He states that the deposit paid is non refundable under any circumstances.
I live on a new build estate and this tradesperson has for the past two weeks been advertising his services on my estates online forum stating a 10% discount for work that is undertaken in March.
What is my legal position here? I cannot force him to come and do the work, but cannot also afford to lose my deposit. I feel that I am being given the run around being an elderly female and he possibly thinks he can turn up anytime he has no other work.
I have had to cancel the installation of my shed and also the painter who was following on to paint the shed and fence panels along with the turf supplier who was going to turn the rest of the garden once this hard landscaper had finished.

How are you communicating? In writing?
What details do you have for this person? A business address? Phone number?
When was the initial start date? What was it changed to?
I would politely contact them in writing (email is fine) stating that could they please give you a start date for the work within the next 14 days, or issue a full refund of the deposit paid if they are no longer able to carry out this work.
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0
