waiting 2 years for a refund..

So I bought some tickets for me and my friend on the website motorsporttickets .com 24/01/2020 for £608, the event was then cancelled from formula 1 and was offered a refund from the company for £569 because you don’t get admin and delivery fee in the refund . Fast forward to last week and they are still replying saying 


“Hi Kris,

 

Thank you for your email.

 

Our finance department is working hard to process all outstanding request. Unfortunately, the have not been able to process your request just yet. Rest assured that Motorsport Tickets is doing everything we can to get this processed as quickly as possible. As soon as our finance department has advised us that the refund has been processed, we will update you in a separate email.

 

If you have any further queries then please do let us know.

Kind regards”



I bought these on my credit card 2 years ago and Ive lost my patience with them.


What can I do? they just repeat that above email and have done for 1 year alone. my credit card company wont help as its so long ago.

    How did you pay for them? You'll be time barred from a chargeback but if you paid by credit card you could go down the S75 route.

    I've no idea the size of the company but for these sorts of things it feels more likely to be a liquidity issue than a lack of people in finance to process the refund.

    It may be worth contacting your credit card issuer again, and stating you want to make a Section 75 claim. 

    My understanding was that Section 75 gives you the same rights against the card issuer as you have against the retailer - so there should be no issue of it being too long ago. Others on this board have a better knowledge so may be able to confirm this or set me right.

    My only thought on S75 would be just what was the breakdown of the costs.
    Do they include travel, accommodation etc?

    But certainly call your card provider, just have all the details to hand. 👍

    Was any travel insurance taken out?
    What about their booking protection scheme?

    Re: S75 - are you sure this would work? Presumably motorsports.com are just an agent for Formula 1 and thus working on your behalf. Have they even got the refund monies from F1 yet? Their email is ambiguous at best.
  • it was just race tickets for the f1 race its self. i think my credit card merchant said with it being that long ago they wouldnt help me.

    That would be chargeback that is limited to 110 days, S75 is 6 years effectively
  • just rang them, they couldn't give me a timescale on how long the s75 would take though, ill keep you's updated.

    I am contacting you about your recent claim made under Section 75 of the Consumer Credit Act 1974 (“the Act”). You claim that Singapore Formula 1 Grand Prix 2020 (“the Supplier”) has breached the contract that you both entered into for an event that did not take place.

     

    Having assessed your claim, we have concluded that you do not have a valid claim against NewDay Ltd under Section 75 of the Act. 

    The reason for this is that in order for the Act to apply, there needs to be a direct link between the Debtor (yourself), the Creditor (us), and the Supplier (Singapore Formula 1 Grand Prix 2020).

     

    The payment from your Aqua Mastercard was made to Book Events London who acted as an agent in order to sell tickets on behalf of Singapore Formula 1 Grand Prix 2020.

     

    You did not enter into the contract directly with the supplier of the service therefore a break in the chain has occurred as there is no direct link between the Debtor and the Supplier. This means that NewDay Ltd do not share liability in this claim under the Act.

     

    We have made this decision to decline your claim based on the wording of section 75 of the Consumer Credit Act and your scenario is not covered by this legislation.
