Erroneous transfer advice required

    It sounds like the new owners are the ones who messed up, so make it their problem to fix it.  They signed up for energy from SP in January under their name.

    Leave EON out of it.  So far as they are concerned, the account was closed and moved to SP in January.  Trying to reopen an account now is just complicating things.

    I would take a mercenary approach with the new owners.  They are the ones who signed up with SP.  The bill is in their name.  They need to sort it.  Offer to come to an amicable arrangement with them (not SP) to pay them back for the bill for those months.
    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    The thing that strikes me is that you don't owe anyone anything....well not legally.  If all the Eon bills were in your ex's name then he's the one should pay the bill.  That the new residents signed up then means it's their bill.  You could, I believe, ask for a subject access request with both Eon and SP and say "where did I sign up to any account with you?"  It's unlikely they would be able to connect the dots as you never did, so likely they will say you personally have nothing on file with them.

    That said - for fairness I would ask for the bills (from the new residents?) for the time Jan to May when you lived there.  I would then pay that amount of money directly to SP and inform the new residents of this.  And then walk away from it all.  You didn't make this mess, they did.  Likely first time buyers who were overly eager so I feel some sympathy but not enough to pay them off or anything.  Just make things right like as if it didn't happen.

    An erroneous transfer also triggers a compulsory compensation payment to be made within 10 days of the breach occurring. Failure to pay compensation within 10 days triggers a second compulsory compensation (£30 in each case). Both suppliers are liable, so you could be in line for up to £120 - Maybe that is why both EDF & SP are trying to dodge doing "the right thing" (that and it would have to be reported to OFGEM).

  • The ET request will have been rejected for 2 reasons, one it’s over a year ago & two, the OP no longer lives there. 
    I think she(?) really needs to ring SP to be able to sort this out. Raise it as a complaint - getting the reference number- and explain that they didn’t sign up, as I’ve said in a previous post, SP will have a copy of the original contract which will be in the name of the new owners and possibly notes from the new owners saying they didn’t move in until May. 
    A final bill will then have been produced & new owners possibly have given OP’s name for the usage between Jan & May rather than partners or it could be just in the name of the owner/occupier. If that’s the case she is liable for it as energy she has used regardless of the situation. 
    She knows a final bill was sent by eon, knows correspondence from SP was being delivered long before they moved out & just assuming it was sorted when in Feb when it was noticed is no defence. Have to ask for an ET to be raised, eon wouldn’t just do it off their own back.

    Do you know *why* they did this? Not that it likely changes anything, but I am curious. I know you said 'jumping the gun' but it was five months before completion so that's stretching the term a bit!

    Think they were just really really keen to move. They'd been living in a parents spare bedroom with a toddler having sold their house, not wanting to lose their sale, for many months by this point. 🤣
