Can I claim back insurance whilst my car is being repaired for an accident which wasn't my fault?

Options
In November, my neighbour reversed their car into mine causing damaged. The neighbour admitted total liability and their insurance company is handling repair of my car.

My car has been in the garage for nearly three months now. During this time I've been paying my cars insurance whilst not being able to use it.

Would it be possible to claim back the insurance I've been paying from my neighbours insurance company?

    Have you had a courtesy car provided for free? 

    EDIT - No you cant as you would be paying for your insurance if the accident hadn't happened. The point of a claim is to put you back in the position you were should you have not had an accident

    No, you havent SORNed the vehicle and so have a legal requirement  to have insurance.

    Do you have a replacement vehicle? Hire car or courtesy car? If yes, that is what you are getting instead. If not then you can look at claiming loss of use of your vehicle which traditionally was a flat £10/day, normally they'd be challenging the repair times but if its gone to one of their own network repairers then its hard to challenge themselves however it does depend on where the conversations went with a offer of a replacement car

  • Have you been having the use of a hire car whilst yours is off the road?

    if not, you can claim for a daily rate for loss of use which will more than likely cover the cost of insurance.

  • As pointed out, your car must either be SORN'd or insured. The more important point is why has the garage had your car for three months?
