This "leaving site" nonsense is almost impossible forr a scammer to get past a judge. It may breach the Human Rights Act, it is certainkylikey to be an unfairs term in a consumer contract, What happens if your car will not start, you hat blows off. Read this and complain to your MP. ihum eYou never know how far you can go until you go too far.1

Just be very careful in the appeal not to say 'I didn't leave the site...'. The DRIVER didn't.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That's very much to your advantage. Aside from the very uphill struggle they would have enforcing a "left site" claim in court, using the word "may" makes it even harder. They don't specify the conditions under which you "may" or "may not" get a parking charge. Such ambiguity is often fatal in trying to enforce a contract.rp112 said:
It says you may receive a parking charge if you leave the site. Very confusing sign and almost impossible to read unless your very close up.2 -
Managed to get this charge cancelled.
I did appeal the charge immediately via the UKPC website. I based my argument on lack of signage, site not defined, no real evidence of driver leaving the site and inadequate signage.
Note, on the UKPC site, there is a character limit, hence you need to write-up on the appeal fairly concisely.
Thank you all for the support in enabling me to get this result, the templates & tips on this forum were very valuable.1 -

Nicely. They really struggle to make 'driver left the site' charges stick, and UKPC do (fairly) routinely cancel when real challenges hit them between the eyes. But there are plenty of mugs who panic and pay. They lose little sleep over those PCNs they cancel, as they know they have little real chance of succeeding, especially when they see that MSE is probably involved.rp112 said:Managed to get this charge cancelled.

I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
