Without meaning to ask the obvious, was the accident your fault or the driver's?
Bear in mind that the driver might try and counter a claim if they believe they weren't at fault, and could even counter-claim for damage to their car.
I hit a pedestrian through no fault of my own, and when they tried to blame me for the accident I used my home legal cover to counter-claim for the damage to my car.
In the end this caused them to back down and all claims were dropped, however they did have to pay the ambulance chasers a cancellation fee (which they had the gall to ask me for - my reply was less than polite!)1 -
