Hi, can anyone help me please?
I ordered a manual recliner chair from Cousins furniture store in May2020. They told me it would take 18 weeks to be made and then delivered, so it would arrive in November. November came and went with no correspondence from them. I called up to be told there was a delay and it would be December. December came and went I called again to  e told it was in the country but there were no HGV drivers. I asked for my money back to be told they would not do that. So eventually after moaning at them the chair was delivered Tuesday 25th Jan. When  it arrived it is the electric recliner, I remarked about this and the driver said don't look a gift horse in the mouth. So I signed for it.
Today Thursday 27th the manager called me to inform me the had mixed up my order and delivered the showroom model, and could they swap it for the one i should have had.
I would like to keep the one I have sat in my front room, but do not know my rights.
Can any one enlighten me please?

    Your rights are to either pay for what they delivered or swap it for the one you ordered - there should be no cost to you for the swap.

    By the way - I assume you mean 2021 not 2020?

    As above really, but I would add that make sure you arrange with the shop for the chairs to be swapped- do not give up the one you have unless your own one is delivered at the same time- and make sure they understand that.

    I suspect if you give them a choice of a few collection/delivery days there is an outside chance they might just let the matter drop if not then you have lost nothing apart from the inconvenience of a second 'delivery' day.

    If you'd not normally be at home, and would have to be for the second delivery/collection, then you can charge them for loss of vacation / loss of earnings that have been incurred due to their error. (But you can't just make this up - you'd have to prove that this loss really happened).

    And as asked earlier ... is May 2020 a typo?

  • As above - you aren't entitled to keep what you haven't paid for, only to have what you have paid for.

    You say you prefer the model they delivered.  If it's an ex-showroom or demo model there's nothing to stop you approaching them and negotiating with them to keep it at a little additional cost to yourself.  It's not brand new and it might be less hassle for them to let you keep it for a small extra charge - depending on what you consider "small".

    If you don't ask you won't get.  You might be pleasantly surprised...
  • You've got something you haven't paid for - so you either pay the difference or let them swap it.
