Doctor wrote a letter saying I'm not able to work anymore but job centre won't listen!

Hi, 

My Dr wrote me a letter stating that I'm unable to work anymore. Had my assessment with the DWP and they have put me in the work group. I've complained to the job centre but they insist that I need to apply for jobs and see a work coach etc. Despite me telling them and having evidence I'm not fit. So what is the point in applying for jobs that I can't do! Just venting really the system is just ridiculous!

    If you were found to have limited capability for work (LCW) you shouldn't be expected to look for work. You maybe expected to attend appointments and to prepare to work sometime in the future.
    When was the decision made on your work capability assessment?
  • Before Christmas. My Dr's letter states I'm not fit for work at all so I can't understand why they expect me to prepare for work in the future.

    You need to request a Mandatary Reconsideration of the decision.
    To qualify for Limited Capability for Work and work Related Activity you need to meet any one of the following descriptors or be at significant risk if not so found

    Precisely which group are you in ?

    If you have been assessed as fit for work, then you may wish to appeal that decision. See your decision letter for more details.

    If you have been placed in the LCW group then you have to attend work-focused interviews, but do not have to apply for jobs. 
    (You can also appeal this decision if you think you should have been placed in the LCWRA group)

    The WCA supersedes any fit note you may have from your GP.  Did you fully explain your health conditions and limitations on the UC50 you completed, and to the assessor?

    You cant rely on what your GP says.
    They have a personal relationship with you, and take everything you say as fact.

    You need to look at the LCW and LCWRA descriptors to see where you fit in

    Your GP has written you a letter, what was the intended purpose of this. Did you submit this letter to the DWP to find it has been ignored/ rejected? Were you issued a fit note, if so, how does this letter sit with fit note?

    The trouble is that the Dwp think that you are fit enough to work even if it is in a different occupation than your previous employment

    No, not if the decision was LCW, they acknowledge they are not fit for work but are expected to attend appointment to prepare to work in the future.
  • Hi, 
    Thanks for your replies. So my GP and consultant issued reports and medical facts for my assessment but the questions they ask during the assessment aren't very relevant to my illnesses I phoned the DWP up yesterday and have complained and we went through my assessment results again and my medical evidence and I'm being awarded it now with no need to look for work and no more assessments needed. I think I was just unlucky with my assesor!
