It would be true to say that you have a salary sacrifice arrangement and you will be required to pay a fee for early termination.
Duggz0r, are you quite sure your contract says nothing about early termination if you resign? Look for a statement similar to the following:If you leave voluntarily or are dismissed for disciplinary reasons before the end of the term, you will be required to pay a fee for early termination from your final full salary. The amount of the fee will depend upon how much your vehicle costs to lease and the remaining term on your contract. If the fee exceeds your final salary payment, you may be required to reimburse your employer for any excess.Every Salary Sacrifice agreement I have ever seen has contained the above clause in some form.
The most elegant solution, and one which is often done, is for your new employer to novate the lease into their name and operate a salary sacrifice arrangement for you. Neutral cost to your new employer, the lease company and old employer are happy and you keep your car on the existing terms. Have you proposed this to your new employer?2
