Parking charge Knutsford services

HI ALL
I was issued with a parking charge notice back in January 2017 for parking on MOTO services M6 junction 19 Knutsford however i never actually parked there as i used the access road that is situated on the southbound side services between both the entrance and exit cameras while traveling to a new job that i was starting that day in Macclesfield Unfortunately due to not knowing the area i used this same access road instead of the northbound one further down the road when i was returning home this would then of had me recorded by the entrance camera in the morning and the exit camera in the afternoon.
I have had numerous letters form CP Plus DRP and finally dcbl all of which i have ignored ( yes i now know i shouldn't have ) however dcbl have applied for a claim to the county court as i have received the claim form in the post.
I have waited the 5 days then filed my acknowledgement of service online which will give me more time and also wrote my defence around these details i also applied to the place of work for proof of being on site unfortunately being a subcontractor and the time that has passed this is not available.
I thought i would post here in the chance someone has any insight on this matter before i file my defence
any help would be very much appreciated thanks.

Hello and welcome.
What is the Issue Date on your County Court Claim Form?
Upon what date did you file an Acknowledgment of Service?
Your MCOL Claim History will have the definitive answer to that.

Get in touch with the motorway service area, tell them that the vehicle made two visits to the motorway service area at times X and Y and that you have data to show that you/the vehicle was not on site for the time their defective systems show , and it would appear that they are relying solely on flawed automated camera systems, and ask where the foot patrol was that should be checking to see if overstaying vehicles flagged by the cameras was on that day.Im assuming this is the road/area you used:Clearly showing a blue direction sign, which means "all vehicles MUST turn Left. Round blue signs such as this are mandatory directions and people have been fined by real authorities in places such as London for not following these.Next up just before the badly marked out zebra crossing is what appears to be a bad attempt at a home made no entry sign .As far as the complaint to the MSA is concerned the fact that the vehicle may have left the site - as directed by the signage is irrelevant - however the vehicle did make two visits to the site , and as a result of their flawed systems they obtained your data without just cause

With a Claim Issue Date of 7th January, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Wednesday 9th February 2022 to file your Defence.
That's two weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.4 -
thanks for the info 👍👍0

Some great photos that I'm sure will help in the later stages of your case. Not at Defence stage, but some months further down the track when you come to preparing your Witness Statement and Evidence.A picture paints a thousand words .....Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Hi folks would this be satisfactory for defence or would I need more detail.
Thanks..0 -
You should add that the vehicle was never parked nor even in the MOTO car park and clearly the ANPR cameras are wrongly placed.
Also read the new Code of Practice out this week, all over the news! All over this forum too. It's the best thing that you could possibly have available to quote from. Some Defendants seem to have missed it entirely this week.
You will want to quote from the ANPR section as well as tell the Judge that the Government has banned fake debt recovery fees in these cases.
Read the Code and the accompanying Explanatory document.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
