DFS Cancellation Rights

Hi, I purchased 3 sofas from DFS in store on the 14th January. Paid a £1000 deposit and took out a 3 year credit agreement on 0% finance. The sofas are standard colour and size, purchased off spec. I contacted DFS to cancel the order on the 22nd January. They followed the phone call up with an email to advise it would take 21 days before the deposit would be refunded. Today I have received a call from the DFS store where I purchased the sofas from to say I cannot cancel the order as the furniture is made to order and have told me my £1000 cannot be refunded. Can you advise my rights please?

If your purchase was in store you have no right to cancel.  You have a right to withdraw from the finance agreement but that simply means you would have to pay by other means.

Can cancel the finance but means you need to pay in full.

Failure to pay means a breach in contract which doesnt mean they can keep £1,000 but means they can look to you for their losses as a result of your breach which could be more than £1,000 or less depending on where they are with your order and how they can mitigate their losses.

Why are you cancelling your order? Its up to you if you want to fight and may end up paying more than the £1,000 already or accept your error and give up the deposit.

I suggest you turn on the charm and try and persuade them to help, because you have no right to a refund.  Are there other sofas in their range you could swap to?  I'm sure they'd be more amenable if they knew they weren't losing your custom entirely.
