I have a hire car with europcar through motability, europcar received the ParkingEye fine and paid

Hi,
We have a hire car currently from Europcar through Motability as our normal Motability car has been in the garage for the last 4 months. This morning we received a letter through from Europcar saying that they had been issued with a Parking Charge from ParkingEye for the KFC at Walkden Manchester were we had parked for 13 minutes on 17/12/2021 between 09:42 and 09:55 on a car park with a 0hrs 0minutes max stay (I found out today after googling its apparently no parking at all until 10am) yet the signs don't even tell you this until after you are already on the car park. We parked whilst my partner was having her medication as it was due. The charge was issued 20/12/2021 by ParkingEye.
Europcar's letter then preceded to say that they had already paid the charge at £60 pound and then included an invoice dated 06/01/2022 for the £60 plus a £31.62 third party administration fee. Their letter said we could still appeal to ParkingEye even though they had paid it yet the ParkingEye PCN said this had to be within 28 days. We only received this letter through the post this morning which basically means that Europcar have removed our right to appeal by deciding to pay the fine and not communicating this in a timely fashion.
I do not want to pay this as feel that:
1. The parking charge was issued unfairly due to lack of signage before entry to the car park to state that you couldn't park before 10am, let alone for just 13 minutes which would have caused no loss whatsoever to ParkingEye which I believe was what the parkingEye vs Beavis case was related too. No loss was caused to Parking Eye or the owner of the car park by us parking for 13 minutes before 10am.
2. Secondly, Europcar took away our right to appeal the fine by firstly deciding to pay the fine rather than provide my details as the lessee of the vehicle and remove their liability, but to then not notify me in a timely manner of such charge is unacceptable. I feel completely ripped off by both companies. And not only have they taken away my right to appeal they have charged me extra for the privilege too.

it's likely you would have lost at POPLA because if's run by the trade body and just repeats the BPA CoP new 2020 mantra, that drivers only get a truly pathetic five minutes flat, to drive in, read signs (even in the dark), decide to leave and actually drive past the exit camera.
But try an appeal to PE anyway online if the system lets you.
Try a complaint to the landowner.
With a hire/lease car it is UNSAFE to use private car parks at all right now, until this horrific greedy industry gets regulated this year. You can never be sure you are not going to get a PCN posted for any old excuse to the registered keeper, Europcar.
You are safer parking on street at the moment.
Having said that, what does your Europcar lease agreement say about parking charges & admin fees?
Why didn't they just name you, as per the BPA/BVRLA memorandum of understanding?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi thereI parked in a PE car park. I paid cash at the machine. I entered in my number plate in. It wouldn't take a coin so it took a while to get ticket. My ticket didn't have my number plate on it for some reason.

When a PPC is reduced to £20 it often means that they recognise the weakness of their case and would rather not take this to court. Was this marked "without prudice"? Have you complained to your MP?You never know how far you can go until you go too far.0 -
@Timbo29, you really should start your own thread/discussion as it can get untidy and confusing trying to answer two posters on one thread. Having said that is looks like a keying error, yours or faulty PDT to be determined but more info in NEWBIE sticky and your own thread when you start it.
