Debt Recovery Plus

Hi All,

My sincere thanks to anyone who reads and replies to offer help regarding this post. 

I have a parking fine which has now gone to Debt Recovery Plus. I did not appeal my parking fine in time, I should have as I have proof via my bank statement that I did in fact pay £1.20 for parking. 
DRP told me that the reason I could still be receiving the fine is that I may have put my number plate wrong into the machine.. however I have not been refunded the £1.20. 

The fine is now £170 they said they can accept a 10% discount bringing it to £153 - which I obviously do not want to pay because I paid for parking originally at the same time though I do not want to go to court for this and have to pay solicitor fees. 

Can anyone help me with an appeal on this? or tell me how I get out of not paying? is it best to contact the original car park company before it went to DRP?

    PPC means private parking company
    The newbies thread is at the top of page one of this forum.
    You do not have a fine you have an invoice.
    You do not have a debt so stop phoning useless debt collectors.
    Read the newbies thread it's all explained there.

    It is not a  fine, and it is not £170  Read this, read the newbies, and complain to your MP.

    They have added what appears to be an extra unlawful amount  of £70 for debt collection.

    This amounts to double recovery and Judges all over the country are dismissing these spurious additions. Indeed some judges have dismissed entire claims because of this. Read this and complain to Trading Standards and your MP,

    Excel v Wilkinson

    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    Also consider complaining to The SRA about the solicitor, if one is involved They are fully aware of the unlawful nature of most of thse additions yet persist in adding them..

    DRP .......  without doubt are one of the biggest clowns in the UK. They are simply money scammers and have added the fake £70

    TOTALLY IGNORE DRP AND NEVER PAY THEM AND DO NOT CONTACT THEM.

    DRP are members of the infamous BPA who love their scammers and dreamers

     
  • @Coupon-madI have sent PALS an email as informed to do so in PLAN A but I have not heard anything back from them and I am worried the longer I leave it the more likely I will need to got to court over it.
