France Covid lockdown December 2021

Hello

I'm trying to find out whether the travel restrictions imposed by the French government in December 2021 preventing UK residents from entering France for touristic reasons wereactual laws. Would it have been illegal if we had travelled to France for tourism purposes during this time?

    You would have been denied entry if you travelled purely for tourism purposes- if you had lied on any official forms and pretended that you were travelling for any other reason then I would suspect making a fraudulent statement would be enough to cause you issues.

    The issue I'm facing is that a ski company we had lessons booked with in France have refused to provide a refund claiming the contract has not been frustrated. I'm struggling to see how it hasn't been frustrated when we wouldn't have been allowed in the country?!? We're being treated as a "no show".
  • I've received legal advice saying that they are not complying with the Consumer Rights Act but they're saying they are. Very confusing.

    The Ski Company was fully operational and open for business.

    Which consumer Rights Act- the UK one and Why does the person giving you legal advice believe a UK act can be applied to a place in France?

    It sounds about right though, look on the holiday and covid boards, lots of people losing money because travel restrictions mean they can't travel, you will need to look at your insurance as you may be covered with that.

    Didn't your travel insurance cover this aspect of the holiday?

    If this had been a package holiday including transport to France then the contract would have been frustrated and you would be entitled to a refund . However if it was just ski lessons booked independently and these were still operating ( not cancelled) then you aren’t entitled to a refund from the company as they were still providing the service that you paid for .( It’s not their fault that you couldn’t get there) 

    You will need to claim on your travel insurance, if your policy covers changes in entry requirements .

    The issue is that this was a UK-specific rule, so assuming French law and that this wasn't booked as part of a package, then the services were still available to you.

    I was in France (not for tourism) on the date the new rules came into force and as long as you were in France before this, you would have been able to continue your trip as normal. It's unfortunate you weren't.
