Lodger lied during application, outcome on page 29...!

    i guess I would try to come up with some standard reason why you need to give notice, dont even mention the background check, say your work requires you to leave for 4 weeks in 10 days and you need to give notice.

    if that didnt work, i would make sure that you have somebody with you on the day you tell him why he needs to go etc. nobody likes to be called out a liar and usually enters a defence mode, and defense mode can easily start an argument, and arguments can spiral out proportion / become very very unpleasant, etc


    How ironic that the post is headed "lodger lied during application", you say "nobody likes to be called out as a liar" and yet you appear to be suggesting that OP lies!!!!!

    Your opening post says "...but he didn't mention any of this during the application...", but there is no suggestion that you asked him whether he had any convictions. Why do you think it's his responsibility to volunteer information that hasn't been requested? Perhaps if you look for a lodger again you'll be a bit more comprehensive in what you ask when interviewing. I agree that this probably isn't the sort of person to share your home and hopefully he'll be gone soon but you have to accept some fault.

    my employer requires a standard background check. He said that would be fine. He paid the deposit, agreed to pay went weekly in advance and was told very clearly and in writing that if the Credit or background check returns anything different it may result in eviction.
    I assume from that it was clear the 'background check' was additional to the credit check, so yes, lodger should have known and disclosed.
    The fault was in not waiting for the checks to complete before taking the rent and handing over the keys.

    I wasn't aware that a landlord was able to do a background check that will list a potential tenants criminal convictions.

    I believe in second chances and good people who just made a mistake. However I don't believe in 14th chances, I don't know about you?



    People do change, especially as they mature, although it doesn’t seem like this particular person has.

    I would not completely write off the possibility of 14th chances in the right circumstances.

    I personally would not be comfortable having such a person as a lodger.

    I will need to feel safe in my own home.

    Can you evict them or are you comfortable?

    A major error was letting lodger move in before you had gotten the background check.
