Default notice question

Hi, 

Just a quick question, I was on a dmp via stepchange which ended july 20 (started dec 16), however I noticed on my credit score via my bank that santander had put a default notice dated oct 19. 

Says it will remain on my score until 24 (or maybe 25).

I thought it would have started from when i originally defaulted.

  • It falls off your files 6 years from being applied.

    If the account was not originally defaulted, you need to address that.

    Seems I just have to accept it, was never advised of this, Ive known a few people who have went  down this/and other avenues and its been the standard black mark.  Basically they can apply it whenever they want. 

    Should have known with my luck.

    Not sure if I still have docs but Im going to look up when I received default notice, surely they cant do multiples?

    9 years black mark.

    That's pretty defeatist.  I would be challenging it for an earlier default, but it's entirely up to you. 

    If you're not going to do anything about it, then it's nothing to do with 'your luck'.

    Its pretty easy to dispute a default date, a simple letter of complaint will suffice, and in most instances a creditor will agree that their actions did not comply with guidance, and alter the date of default for you.

    Lets be clear here, your credit file must be marked  in some way to show you have not made the contractual repayment, you should ask Santander to backdate the default to within 3 months of the start of your DMP.

    Thanks, sorry when the girl at stepchange told me she seemed to make out there was nothing I could do, tbh Ive found them very good for the most part but she wasnt the most helpful and tbh most considerate.

  • I'm also in a DMP. I've discovered 1 of the debts of mine was never defaulted but then sold off a year later was then defaulted by the new owners. 

    After finding this forum I've sent a complaint to the new debt owners asking them to follow the ICO guidelines. My only issue is (I think) they'll say because they never owned the debt when I'm asking for it to be put back to, they'll refuse. Knowing my luck I'll have to ask the original credit card company to retrospectively default me and they'll probably refuse.

    ICO guidance would be to not default you as you were in a payment arrangement and (presumably) kept to it.

    If they stick with ICO guidance you'll end up with AP markers until you stop repaying or repay the debt...

    I know this is an oldie but still ongoing. Just for others info.

    I am waiting information back from The Fin. Omb but it appears that Santander issued may with a default notice when I originally thought at end of 2016, however they then further applied what they called a Post Maturity Notice on the interest which I'm assuming they didn't agree with Step Change that the DMP was acceptable, although they've actually wrote off the debt now.

    So waiting to hear from FO on their take on it, but I'm not holding my breathe, but just a bit miffed that I was never made aware or even knew that there is the possibility of black marks against your name for 9 years or maybe even more possibly.

    Another update, which may help someone in future.

    FO agreed with my issue and advised that this be removed, they also requested a small monetary figure to be paid to me due to the issue.

    Today Santander have agreed with outcome so notice will be removed.
