Finding ut a challenge to get money refunded from online order from US

I ordered several items from an online company based in the US. On arrival one of the items (blouse) was inside out and had a stain on it, whilst another two of the other items (lingerie) were damaged and not fit for purpose. I decided to return the majority of items to the sender and had to email them to request returns address. Instead of providing address they, on more than one occasion offered to give me a discount, which I declined. They also stated they could not refund money for lingerie items. I disagreed with this response stating items were faulty and could not be used and my rights were to have money refunded. I paid (£26) returning the items in the original packaging using Royal Mail and completed the Air Mail Imigration form as it was going to an address in the US. I then emailed the company to advise of this and also attached a photo of the proof of postage receipt, together with a note highlighting the goods returned. It is now a month since I've returned items and no refund has been processed. I've contacted company to chase up refund more than once but keep getting the run around and stalling tactics and now they are saying as I did not get a tracking number from my Proof of posting Certificate they cannot refund my money. Where do I stand with my consumer rights? It is too much money for me not to get refunded.

You've ordered from the USA and so your rights are almost certainly based on the state in which the seller is based... needless to say US consumer protection in most states is massively lower than it is in the UK. They do vary significantly by state though.
Assuming you paid by card you are probably best off looking to your bank about getting a chargeback done as the scheme rules dont really consider the international variations in consumer rights.1 -
As per @Sandtree you almost certainly have no UK consumer rights and it depends what US consumer law says. and you'd have to enforce your rights in a US court.
Again as per Sandtree, get your card provider to do a chargeback or s75 as appropriate.1 -
Would agree chargeback, but you will not get your £26 back. Only the amount you paid for the items.
I would not be surprised given what you have said, that in reality this is a retailer based in China.Life in the slow lane2 -
yes agree a chinese seller masquerading as a usa seller1

Inside out and stained clearly is said to imply previously used... do goods ever get back to such far east companies for them to be able to resend them as "new" to another customer?cx6 said:yes agree a chinese seller masquerading as a usa seller
I'll sit on the fence unless the OP gives the URL of the company in Q1 -
Thanks for advice so far. Will certainly look into discussing with Bank. Return address was US, but I suppose as some have suggested they could be trading from China.
