Joint debt

Options
I have been notified by my bank that bank account held jointly in my ex husband and my name, has now been transferred into my sole name at his request. The bank account has an overdraft on it.  I’ve checked the terms and conditions on the account and it states that it needs both signatories or should be in credit for this to happen. Yet it’s been done/ I made a complaint to the bank and I was told that they can’t discuss it with me. The matter was dealt with and the account transferred to me.  I don’t get this at all. Ive been in a seriously terrible financial position since I got divorced and had asked the bank numerous times for support on the debt. Yet nothing happened and I didn’t receive any help.
I am getting support from the citizens advice and other charities with regards to other debts that have been left for me to resolve that was in joint names too.

  • That does not sound correct at all, but you would better of posting this on the banking board.

The bank cannot remove someone from an account unless both parties agree to this. Did you agree?

Put in an official complaint with the bank

If it is a joint debt there could have been a mistake to just be passed into your sole name.
Did you sign any documents agreeing to this?
If not make a complaint with the bank.

A joint account can be changed to a sole by one party at some banks and only with both signatories at others, there is not consistent approach although I'd suggest something has gone wrong here, no bank would willingly allow a debtor to walk away by removing them from the account.

Leaving all that aside for a moment, this is something that really should have been taken care of as part of the divorce, a full and final split of all assets and liabilities. So what was the divorce agreement regarding liability for the overdraft?
