I received a charge notice from Euro Parking Services this week for parking on a private car park that last time we parked on it a few months prior wasn’t, it has something to do with the Chinese Restaurant next to it.
I can honestly say hand on heart we never saw the signage it was extremely dark and I remember having to put the inside light on in the car to see what we was doing, we had parked up eat a snack and drink and just relax awhile as it had been a long car journey and we still had miles to go.
is this suitable defence?
I really don’t want to pay these people, so far I have ignored the notice.
helpful advice much appreciated 🙂

is this suitable defence? How far away are you from the car park? Is it feasible to take night time photos of the missed signage? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

A defence is based on
POFA 2012
CRA 2015
No landowner authority
Poor and inadequate signage
The relevant CoP in force at the time
But ideally , plan A in the newbies FAQ sticky thread near the top of the forum in announcements1 -
Yes I can go this weekend and take photos thank you 😊1

Are you out of time to appeal? 21 days.
Not that you can have a hope of winning an IPC appeal, due to the way it's all set up. Just wondering about dates.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Have you read the newbies? Have you complained to your MP ? If you did not seen the signs it is likelly that they are not sufficiently prominent. Read the ATA's CoP wrt signage. You never know how far you can go until you go too far.1

I’m not out of time to appeal only got notice last weekend, which I stupidly threw in the recycling bin in temper!
I don’t think I have any grounds to appeal if I’m truthful so I will pay but I can’t yet because I don’t have the damn ticket reference number, So I will have to wait for the next one, which means I’m going to fork out £100 😫

Sod it!
im going to wait for the next notice and appeal, I’m a Nurse work my !!!!!! off for my money and don’t want to part with it without a fight, I’ll throw all I can at it.0 -
Good that you will fight. Just from what has been written so far, it would appear that you have a good defence with poor signage, as well as some of the other suggestions. Do not forget Plan AThe pen is mightier than the sword ..... and I have many pens.2

Thank Goodness! It's because ordinary people like us have made a stand and refused to roll over to the rogue practices of this industry, that the Government has stepped in and the motley crew will be regulated later this year.Boodee said:Sod it!

Right now we make the best of a bad job and use the useless farce of an 'appeals service' as well as PLAN A of inundating landowners with complaints, where their PPC is out of control.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If you decide to pay, consider this first
Last year an MP in the HoC linked some of these companies with organised crime. The money you pay coulsd be used to fund county line,, peoople smuggling, and modern slavery. You never know how far you can go until you go too far.1
