Can someone tell me, legally, who is responsible for a hotel booking
I booked a 3 night stay in Nov but the room was not as advertised.
I booked through Booking.com, they made reservation & took the money
They tell me it's not their responsibility as they're an intermediate. The hotel are saying it's not their responsibility as they did not take the money. I have even tried claiming via credit card. Although they did make a compensation payment, as the issue is with Booking.com, the receivers of the monies, they then rescinded the payment as Booking.com has told them that they're an intermediate
Please help on the legal situation with this & who to make a legal claim to

Booking.com is an OTA and doesn't actually take the money. It's the hotel. This makes any kind of claim a bit more difficult if you are going through your credit card for example.
What does it say on your credit card statement as to who took the money?0 -
It depends on what you did when you discovered the problem.
You could have asked them to put the problem right and given them that chance.
If they couldn't put it right you could have left and went elswhere, suing for the cost of the new accomodation, to the value of what you contracted for even if it was more expensive.
If you just stayed then you are in a poor position but you can sue for loss of enjoyent by proving what you paid for and what you got were vastly different. You would sue the provider, so the hotel.0 -

It would help to understand what the issues were and what you did on finding the room was not as advertised.0 -
Any legal claim would be against the accommodation provider, as booking.com are an intermediary. But, they're usually good at dealing with issues arising. Assuming you phoned booking.com when you arrived and matters weren't satisfactory, did they not help? I'm surprised they didn't try and find appropriate accommodation. I worked for a hotel company, and the procedure used to be that if a customer phoned on arrival that booking.com (and Expedia were the same) would try and find alternative accommodation if the hotel had failed to offer what was advertised (and they'd bill the hotel for that) or if that wasn't practical, they'd offer a partial refund for the customer to stay at the hotel as planned but accepting some details were missing (and they'd bill the hotel for that).davecarpet said:Can someone tell me, legally, who is responsible for a hotel booking
