The guidance used to be 3-6 months after payments stopped or the agreement was broken. This has a bit more change if in an agreement of payments depending who you ask.

Good advice there and the comments are worth a read as Sara gives good advice.

Remember a default on your report and a default notice aren’t the same thing either.

Are they contacting you at all chasing? What’s the background of the debt?

There is no requirement for anyone to follow the ICO guidance and if it isn't a CCA debt, the guidance doesn't apply anyway.

    What is the debt for?

They can mark your account as they see fit, creditors usually have a single policy they follow in regard to such matters.

The type of debt, and the associated guidelines would need to be established, in order to take this matter further.

  • You can try asking them but given you're not paying the debt there is no reason for them to give you a favour of default which would eventually let the debt disappear
