Hi All,
I'm hoping you can help me along. Some great advice on these forums that I've looked at.....but I'm trying to establish if I have a defence worth fighting!
I received a claim from the County court business centre. For a parking charge not paid from Dec 2020! This is the first I've ever seen of the charge and it went to an old address (my parents) unsure why.
Original charge £196.28 - does this exceed a legal limit of £100 initial fine?
with court fee, legal reps and interest it's now £281.28 !!
Again its the first I've ever seen of this 'ticket'.
There's a chance I parked there. Definitiely didn't see any signs and don't know for how long. Its on a private business park at a Costa coffee. The fine has apparently been captured on ANPR - any rules on this?
Basically who am I appealing to? The parking company? The court claim? And how. What's a SAR?
I've submitted the AOS and stated I intend to challenge the whole claim. (Well I think I am!)
Any help, pleeeeease.

The fine would go to the address your V5 is registered to.
You say there’s a chance you parked there and you’re not sure for how long… then what do you intend to fight it with??? You would need some evidence to back up your defence, because if you fight this to court, what are you gonna say?!?
They have ANPR images which (I’m assuming) will show the time you arrived and time you left…. What do you have to counter that?
if the answer is nothing, then just pay it asap before it escalates further. You’re responding to the company who have issued the court claim (usually a solicitor), their details will be at the bottom of the initial court summons (2nd page I think). An SAR is a subject access request.
I had a CCJ against my name from exactly this scenario (fine went to previous address as I forgot to update V5) - luckily I caught it in time and paid it off within 30 days of a judgment being entered against me, but an expensive lesson!0 -
Your best bet is to repost your query on the Parking Tickets, Fines & Parking board.
When doing so, please post the Issue Date on the County Court Claim Form and the date that you filed an Acknowledgment of Service.
Also state the name of the Claimant.0 -

I suppose I'm arguing that even if it went to an old address, this is the first and only contact they've made (it's my parents address so I know this), and its now incredibly expensive.
If I was at fault I wouldn't mind if it was the original fine, but not at this increased rate. Is there legally a maximum charge for the initial fine?
I need to go to the site to check on the signage etc as I'm not sure if this is a point to argue yet.
