Am I covered on s75?

Bought car online using wife's barclaycard. May have to return car as faulty. If dealer plays ducks and drake's does s75 cover me?

Barclaycard wife's.

    S75 will only provide any cover if the Dealer actually has a case to answer.  Not just any fault is necessarily a claim.

    If your wife bought the car, your wife would have to make any claim to enforce applicable consumer rights.

    I am aware that I have to get the dealer to sort first, but this is a really bad problem with the car and he is not being helpful at moment. I am just trying to cover all angles. Hopefully s75 will coverm

    You have rights under the Consumer Rights Act 2015. As per info in this link -

    If the dealer won't do anything then yes, your wife can certainly use Section 75. The fact that the car is in your name and Barclaycard is in your wife's is immaterial.

    I used section 75 a few years ago when I bought an old banger that died three weeks after purchase. Car was in my name, credit card wasn't. We received not just a refund but also compensation for the inconvenience suffered.

    Section 75 only covers direct relationships between the card issuer, card holder and the third party. If the wife bought the car for family use, that would most likely be covered, but if it was bought for the husband, it is 100% material to the case as it may well not be covered - same as if cardholder buys a plane flight for someone else.

    S75 covers the cost of the item and some linked costs, you did not get compensation as part of S75 claim, any compensation would be as a result of linked costs or because of a failing at the lender

    Did you or your wife buy the car legally?
    When you say "wife's Barclaycard" you mean her physical card or her account but your secondard cardholder card?

    If it isnt all in the same name you may have difficulties

    Is it the only car in the family? You're not covered as the car is in your name so you would lose.

    If it's the only car in the houshold though you can claim it's used to run your wife about creating a direct relationship to her needed use of the car.

    If there is more than one car it gets a bit more difficult.
