Jet2holidays on Heart, January 2022– Specific Rules

1.     The Jet2holidays promotion (‘Promotion’) is organised by Global (as defined in the General Terms and Conditions). The Promotion will run from Wednesday 12th January 2022 to Friday 28th January 2022 on Heart Network.  The ‘Promotion Partner’ mentioned in these Specific Rules is Jet2holidays.  The ‘Prize Providers’ are Jet2holidays and Global.

2.     IMPORTANT: The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here (together, the ‘Promotion Terms and Conditions’). Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions.

Details of the Promotion:

3.     To enter the Promotion, you must go online to the Jet2holidays Promotion entry page at www.heart.co.uk/win. On this page you will find an interactive plane with seats on the plane representing different Jet2 holidays, which can be won on different days throughout the Promotion. Entrants must select the seat representing the holiday they wish to win, click to “submit” their entry and register their details. Entrants may only select one seat on the plane, thus entering for the chance to win one of the listed Jet2 holidays only. 

4.     At 10:00 each weekday between Friday 14th January 2022 and Wednesday 26th January 2022, four entrants will be randomly selected from all entrants who entered for the following seat numbers and therefore the corresponding holiday: 

Friday 14th January: 2 x entrants from Seat 16C and 2 x entrants from seat 17D

Monday 17th January: 2 x entrants from Seat 18C and 2 x entrants from seat 19D

5.     Selected entrants will be called on the day they are picked and the morning of the following working day. If the entrant cannot be contacted within three attempts on the day they are picked and the following working day they will forfeit their right to the prize and we shall be entitled to select additional entrants from the original entries.

6.     Online entry will open at 00:01 on Wednesday 12th January 2022. Once each round (represented by the plane seat) has closed, it will be greyed out and you will not be able to enter for the chance to win that holiday. For example, entry to win the holidays listed in seats 20C and 21D will close at 10:00 on Tuesday 18thJanuary and will therefore be greyed out showing that the round has closed. The final round will close at10:00 on Wednesday 26th January 2022.  Entries received after this time will not be included in the Promotion.

7.     By taking part in this Promotion you agree the following:

a.    An entrant agrees to join a video call between themself, members of their family and/or friends and Heart Breakfast. The entrant gives permission for Heart to record the call. The entrant consents to Heart sharing the recording, in whole or in part, online at www.heart.co.uk, on its social media platforms and on air. The entrant acknowledges that the recording will contain the imagery and full names of participants in the call, including their own. 

b.    The entrant confirms they are responsible for and have obtained the consent of this activity from all participants in the video call, including the consent of the parent(s) and/or legal guardian(s) of any participants under the age of 18.

c.    An entrant agrees that should they make it through to the Ultimate Final they are available to participate in the final via video call on Friday 28th January 2022. The entrants must also be available to take part in a rehearsal video call on Thursday 27th January between 10am-12pm.

Win Your Seat (Stage 1)

8.     As described in clauses 3-6, each weekday between Monday 17th January 2022 and Thursday 27th January 2022 there will be two ‘Win Your Seat’ on air rounds in Heart Breakfast (06:30-10:00). Two callers will come to air per round and be asked a question.  The entrant selected first in the process listed in clause 4 will be first to answer. The entrants will be asked a ‘nearest the pin’ style question, for example to estimate the distance between two locations. The entrant who answers correctly, or whose answer is closest to the correct answer will win that rounds’ holiday prize (as listed in the Prizes section below) and will win a place in the Ultimate Final. If there is no winner, because their answers are equal, we will take the result of a tie-breakfer question that was asked off air.

9.     If an entrant is not able to take part in the Ultimate Final on Friday 28th January 2022 they will forfeit their place in the Promotion, including the prize won in the Win Your Seat (Stage 1) round. 

Ultimate Final (Stage 2)

10.  The Ultimate Final will take place on Friday 28th January 2022 and will be broadcast live on the Heart Breakfast show.  The 18 winners of the ‘Win Your Seat’ rounds will participate in a game that will take place via video call.

11.  The finalists will be asked questions which will have either an A or B answer. Ahead of the Ultimate Final the finalists will have been sent two paddles. The presenter will make it clear which paddle represents which answer.

12.  The presenter will give the finalists a countdown to hold up the paddle to represent their answer. Their chosen paddle answer must be displayed on cue and their answer cannot be changed, the producer will have the final decision on which paddle answer was on display.

13.  If the paddles do not arrive at the finalist’s chosen address on time, Heart will ask the finalists to use a thumbs up or thumbs down motion. The presenter will make it clear what answer a thumbs up or thumbs down represents.

14.  When a finalist answers incorrectly they will be eliminated from the Ultimate Final.  The presenter will ask questions throughout the Heart Breakfast show until there is one finalist left and the last finalist in the game will be declared the winner.  

15.   In the event all finalists incorrectly answer a question, no one will be eliminated on that question and another question will be asked. For example, if there were 5 finalists left and they all answered incorrectly, those 5 finalists would be asked another question. 

16.   If a finalist doesn’t clearly display a descisive A or B paddle by the end of the countdown for each round they will be disqualified from the Promotion, the producer will have the final decision. 

17.   All finalists will also be asked a tie breaker question ahead of the Ultimate Final, and their answer will be recorded ahead of the Ultimate Final by a producer to be used in the case of a tie breaker. This tie breaker will be used in the event that no winner has been declared by 9:30am on the day of the Ultimate Final.  The producers decision will be final.

18.  We and the Promotion Partner may publish and publicise your name, image, social media handle and/or profile picture, your nearest geographical location (for example, your nearest city, town or county) and your entry, and we may refer to your and any applicable third party’s (for example a guest/travel companion)] association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion.

19.  In relation to winners (and runners up if applicable), you understand that we and our Promotion Partner may: (i) interview you and your guest(s)/travel companion(s) which we may film, photograph and/or record and; (ii) film, photograph and/or record, you and your guest(s)/travel companion(s) in connection with the Promotion, either by telephone or in person, and we may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as we consider appropriate or desirable, in connection with the Promotion. Eligibility:

50.  Jet2holidays are the prize providers for this promotion and are responsible for all elements of the prize fulfilment apart from the travel insurance and spending money which is provided by Global. 

51.  Jet2holidays reserves the right (but shall be under no obligation) to substitute any prize with alternative dates/property or destinations of equal or greater value at any time.  

52.  The prize must be taken by the prize winner (who must be over the age of 18) along with their selected travel companion (who must meet the age requirements outlined above) notified to Jet2holidays in the relevant booking, subject to the maximum number of passengers specified within the prize details. Flights must be taken at the same time from the same airport.  

53.  The prize winner will be contacted by Global within 14 days of winning the Promotion, with instructions on how to book their travel directly with Jet2holidays.  

54.  Any optional purchases or supplements are extra and are subject to the standard Jet2holidays or Jet2.com terms and conditions and any applicable charges must be paid for by the winner at the time of booking for all the travelling party. 

55.  The prize duration cannot be extended, and the hotel and/or room type may not be changed by the winner. Please note, once you have made a booking you cannot amend the travel dates or make any other amendments to your holiday. Additional passengers may not be added to your prize holiday and will need to book separate travel and accommodation. 

56.  The prize is subject to Jet2holidays' and Jet2.com's terms and conditions (together the “Jet2 Terms and Conditions") which can be found at http://www.jet2holidays.com/terms-and-conditionsand http://www.jet2.com/terms respectively. The holiday shall not constitute a ‘package’ under the Package Travel and Linked Travel Arrangements Regulations 2018 (the “Regulations”) and the Regulations shall not apply, nor shall the applicable provisions of the Terms and Conditions which relate to the Regulations.  In the event of any discrepancies between the Specific Rules for this Promotion and the Jet2 Terms and Conditions, these Specific Rules shall take precedence. 

57.  The prize is subject to availability. Please note, prize flights are limited on the flights operated by Jet2.com and may be unavailable even if there is general availability on a particular flight. 

58.  Jet2holidays reserves the right to amend or cancel the flights or holiday without prior notice (which may include changes to the dates, hotel or destination). Please note that the Jet2.com flight schedules are not guaranteed. Flights to certain destinations are only available on certain days.

59.  The prizes include 1 free item of checked baggage per person up to 22kg and airport transfers to and from the hotel in the destination country. 

60.  We will endeavour to transfer the prize money to your bank account within 28 days but are not responsible for any delays.  We will aim to initiate the transfer of funds on the next working day after you provide your details to us.  You must provide all necessary details via the method directed within 14 days after the original request to do so otherwise the prize will be forfeited at our discretion.

61.  Where Jet2holidays makes any changes to the holiday or dates of travel, no compensation or cash equivalent will be available. Jet2holidays will not be liable for any cancellations or changes to the prize draw or the prizes, or for any loss or damage. Nothing in these terms shall exclude or limit the liability of Jet2holidays in relation to personal injury or death caused by Jet2holidays negligence or for fraud. 

62.  You must, at your own cost, comply with all necessary checks, and/or tests required for travelling to and from and entering and exiting your travel destination/venue. This includes, but is not limited to, purchasing, organising, undertaking, recording and/or registering any required Covid-19 tests. We (Global) will not be responsible for any costs incurred by you in complying with this clause, nor will we purchase, organise, undertake, record and/or register any required Covid-19 tests.  

63.  You must comply with all applicable rules, regulations and guidance relating to Covid-19, both in the UK and your travel destination/venue. We are not responsible for your failure to comply with such rules, regulations and guidance.  

64.  You acknowledge and agree that, without limitation to the provisions of Clause 12 of the General Terms & Conditions, our ability to fulfil a prize and/or perform any of our obligations under the Promotion Terms and Conditions could be affected by an actual or threatened epidemic, pandemic, disease or quarantine and/or any corresponding governmental action, guidance and/or ruling (including but not limited to any Foreign, Commonwealth & Development Office guidance) (collectively ‘Covid Measures’).  If due to any Covid Measures, we are unable to fulfil a prize or perform any of our other obligations under the Promotion Terms and Conditions, then we shall not be in breach of the Promotion Terms and Conditions.  In accordance with Clause 66 below, in these circumstances, we reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion. 

65.  Any other costs and expenses which are not specifically included in the prize description are excluded and will be the sole responsibility of the winner. By way of example, without limitation, food, visas, Covid tests or vaccinations are not included within the prize. 

66.  The prize is non-transferable and non-refundable. No cash alternative is available except at our sole discretion. 

67.  We reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion.

69.  Your personal data that you provide to us will be collected and processed by us, our licensees (including Communicorp UK Limited) and our Promotion Partner as well as the prize providers, and if applicable, our service providers, network operators and suppliers in order to administer and fulfil the Promotion. Your personal data may also be disclosed to the Phone-paid Services Authority, Ofcom and/or the Advertising Standards Authority at their reasonable request for regulatory purposes, for example, in order to prevent, investigate and detect crime, fraud or anti-social behaviour and comply with law enforcement agencies and applicable advertising codes. 

70.  By entering a Promotion, you acknowledge that any personal data provided by you in connection with the Promotion will be processed as set out above and in accordance with our Privacy Policy which sets out full details of how we process personal data and how you can exercise your rights as a data subject, and our Promotion Partner’s Privacy Policy found here. Please ensure you have read and understood our Privacy Policy and our Promotion Partner’s Privacy Policy before entering any Promotion. If you are required to submit a guest(s)/travel companion(s) personal data to enter a Promotion, you must ensure that your guest(s)/travel companion(s) have given you consent to provide us and our Promotion Partner with their personal data. 

71.  You may be asked if you want to opt-in to marketing from us and/or our Promotion Partner when you enter a Promotion. If you choose to opt-in, we and/or our Promotion Partner will use your personal data for marketing purposes (see Global's  Privacy Policy and our Promotion Partner’s Privacy Policy for more details). You can withdraw your consent to marketing at any time by unsubscribing.  

72.  We, our Promotion Partner and the prize providers may transfer and process personal data outside of the EEA and UK for the purposes of administering the Promotion. Where any transfers are made outside of the EEA or UK we and the Promotion Partner will ensure appropriate safeguards to protect your personal data are in place.  

73.  We will hold your personal data for a period of up to 3 years in order to comply with our regulatory obligations.  

74.  You may request the removal of your personal details from our database by contacting privacy@global.com. If you request that your personal details be removed prior to the conclusion of a Promotion, you will forfeit your right to enter the Promotion and/or claim any prize and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable.
