Parking charge notice at Pure Gym

Hi,

I received multiple parking charge notices (private firm) for parking at PureGym, despite being a member and attending the gym on the days of the fines and leaving the car park at the exact time of the fines. The fine was for not entering my registration inside as I wasn’t aware.

Initially was being chased by DRP and this has now been passed to CST Law. 

Does anyone have any experience against these companies as I don’t want to pay as the use of the car park was legitimate.

CST have said that I have 14 days (18th January) to pay the debt.

Any guidance is appreciated.

    Ok come back if you have questions after reading the two relevant current threads.  No links needed (see my signature, you are one click away from the first page of threads and the link back is at the top of the page).

    And no using a phone, if that was the reason for perhaps not seeing the Announcement thread in capitals for new posters to read first.  The forum really doesn't lend itself to phone use unless you are very familiar with where the resources and info are.

  • I am reading through the forum now. If they have "escalated" this to CST Law, does that mean I am too late to put in a SAR with Smart Parking Ltd? Or should this be done still?

    Submit a SAR at any time, the sooner the better.
  • Great - I will get the SAR submitted today. 

    Am I right in thinking that I also need to email CST Law advising that I am seeking debt advice by deny any debt, to allow the case to be put on hold for 30 days?

    Yes, you can ask for a 30-day hold any time before a court claim is started due to the pre-action protocol for debt claims 4.2.

    Then that letter is not a compliant Letter of Claim.

    A real Letter of Claim will give you thirty days to respond.

    Suggest you treat that letter as a debt collectors letter.
    Are they suggesting you should pay DRP?

    For clarity the date at the top of the letter is 4th January, it was received today 11th January. I have cropped the image to remove address and registration etc. 

    Please let me know what you think the best course of action is on the back of receiving this.
