It makes no difference to your rights though. You've entered into a contract to buy x items for £y, however you dress it up.

I get your point, but on this particular website there wasn't the option to put 8 in the basket. It was put 1 of the "buy-5-get-3-free" in the basket, like going to tesco and putting a case of 8 beers in your basket that says on the box "buy 6 get 2 free."
