KFC parking ticket

Hi everyone, 
I've done some reading one some other posts and seen the newbies post as well, I will be honest I don't fully understand it. I just mainly need help with what to do now. I've appealed with ce-serve I know it says to go through poplar but unfortunately I left it too late to find this information. It's now at the point where they are fining me £140 I know not to be stressed or anything and I'm not. I just want to know do I just wait until they sent a letter before claim or do I do anything in the meantime?

    you could email a SAR to the DPO at CEL, to obtain all your data

    then you can await an LBC

    meanwhile, follow plan A and complain to KFC or the landowner, get it cancelled , before any court claim

    It is not a fine.

    Complain to the PPC and the BPA that PoPLA should be allowed for up to one year in accordance with the ADR regulations 2015. (The government are actually proposing that this should be included in the new mandatory CoP due to be introduced later this year.

    Also complain to the landowner/KFC manager/CEO as advised above. Explain that you can't afford to spend money there if it comes with a £100 charge.

    Complain to your MP about this unregulated industry, pointing out the PPCs failure to follow the ADR regs. (Look up the full title and relevant parts).

    It's worth getting in touch with the branch/ area managers of Kentucky to see if they can cancel it. Obviously you've been a loyal customer and if this isn't rectified then you can take your custom to other chicken shops/ fast food outlets where customers are valued and respected.  Colonel Sanders would be spinning in his gravy if he could see this! 

    But seriously contacting KFC or the estate manager if its on a retail/ leisure park or services!  Go in person and don't be fobbed off on phone or by a junior level employee.  If all else fails reach out on their social media like Facebook, Twitter or Instagram etc.

    They have added what appears to be an extra unlawful amount for debt collection.

    This amounts to double recovery and Judges all over the country are dismissing these spurious additions. Indeed some judges have dismissed entire claims because of this. Read this and complain to Trading Standards and your MP,

    Excel v Wilkinson

    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    Also consider complaining to The SRA about the solicitor, if one is involved They are fully aware of the unlawful nature of most of thse additions yet persist in adding them..
