Removing a charge from property

Good morning,

I purchased a property in 2007 under a government incentive whereby they contributed 20% of the purchase price in the form of a grant.  This grant was repayable if the property was sold within 10 years on a sliding scale and as such an appropriate charge was placed on the property along with the normal mortgage charge.

As we are now 15 years later, how do I go about removing the charge related to this grant from the property?  Is this something I can do myself as in theory it should be simple so am reluctant to incur the expense of conveyancing if it is unnecessary.  My reason for this is that I am looking to remortgage and lenders don't seem to like anything that is 'unusual' about the register so I intend to remove this second charge beforehand.

    The 'company' (Council?) who placed the charge on the property would need to remove it, so contact their legal department and they will send the appropriate discharge evidence to the Land Registry.

    In theory, yes!
  • Is it possible to get a copy of the details of the charge from the land registry that were on the CH1 form at the time of conveyancing?  I have all the conveyancing documentation but NOT any details of the charge (other than there is a charge).

    No. The Charge on the LR Title simply shows its existance and who owns it.
    The details of the amount owed and/or conditions relating to the loan, grant, or other matters will be in the separate contract or deed agreed between the parties.
    So in this case you need to look at the paperwork you signed with the gov dept that gave you the loan.
  • Land Registry records the charge but does not keep copies of paperwork, so as canaldumidi confirmed above, you need to refer to the paperwork you signed, and/or contact the relevant department to obtain copies of documents.  Having said that, the relevant department should have kept paperwork relating to the charge and it would be them/their legal team who would deal with the discharge.
